I don't know if this is a state by state issue or not,but it's here in Michigan,so here's the question. Is it legal to close off a road right of way with a locked gate if the road isn't maintained by the county or township? The road in this case is on the map,has a name and has always been passable. It was maintained by 2 farmers who used it back in the day. It runs a half a mile between 2 maintained roads. It runs right down the line between 2 townships and 2 half mile long farms. One farmer lived on one road and used it to get to another field on the far side of his farm,the other guy lived on the other road and used it to get to the rest of his farm. There was a strip of nontillabe swamp and woods that the road runs through that kept them from just getting to the rest of their land across their own land.
So,a guy who ain't from around here bought the one long 80 and put up a gate and closed the road. The other farm was sold several years ago,I don't think that guy cares. For all I know,that farm might have even been split,but it's inthe other township,so I'm not up on it. It doesn't matter a whit to me,we used to drive that road a lot as teenagers to get back and forth,but pretty much nobody uses it anymore,I doubt anybody even realizes it's a named road,so that isn't an issue. It's not like I'm going to go turn him in to anybody,just wondered about the legality of it. The road does pick up again another 3/4s of a mile over and IS maintained by the county and runs for several miles,has the same name.
