I am in search of an opinion from the more knowledgeable than I. I have a friend that remodeled his fathers dairy barn fifteen years ago. At that time the banker wanted his dad to sell him a few acres where the barn sat, but his father flat out refused to do so. The bank went along with the loan anyway since it was a family farm. I have always been told if you build something on someone else's property if something happens to the original land owner you cannot claim ownership of the building.
BUT - his dad was so tight he made his son pay the property taxes for the barn since the value was increased. He also had to pay property taxes for his house and cattle shed that he built. He has paid these taxes for the past fifteen years as they are mailed straight to him from the county, and he writes a check to the county. Could this possibly be to his benefit, and could he lay claim to the buildings he paid taxes on? The parents are dead, and the siblings are going to sell the farm. The farm was left to the kids to split equally.
What do you think? Should he talk to a lawyer, or is the law pretty black and white? The farm is in Iowa.
