Trouble with a beaver and his dam

I have been fight a beaver for a couple weeks now. I destory his dam and in 2 days its back. I don't really want the use the 44 option, if I can help it. I may want him doing it later in the year to hold the water but not right now in case we do get some big rains. Sure wish he would move down about 1000 yards then I would be happy and so would he. Dug his dam out today with my backhoe. How long will it take him this time. Got any ideas of how to stop him with out killing him???
