I'm certainly not defending the e-mail and I don't know all of the ins and outs, but there is a way for people to file a tax return, and if appropriate, get a refund of much or all that they have paid in, without the requirement of a Social Security number. Instead, they apply for an Individual Taxpayer Identification Number (ITIN). Among other things, this is how foreign nationals who earn money in the US, and have withholding from their earnings, get some or all of it refunded to them. For example, foreign exchange students, traveling athletes, foreigners who have investments in the US, etc.
Recipients of an ITIN are not eligible for Social Security and cannot claim the Earned Income Tax Credit.
Tax law is extremely complicated, and for every "simple" situation, the IRS has a "complicated" answer.
So, who knows? Maybe there is an element of truth in the e-mail, under the exactly right circumstances.
