Getting rid of contingent fees would make the problem evaporate, but it would also shut some worthy but poor victims out of the system. Seems like the solution might be a much more stringent look at the merits of the case early in the process, such that the lawyer would be on the hook if judge dismissed it as "frivolous" at a preliminary hearing. But the trial lawyers have a very powerful lobby, and insurance companies are eager to settle because they make so much money that they can pay out some losses, so the status quo continues.
