That's not true. The insurance companies handle it case by case. If they can settle for less than it's going to cost if they take it to trial then they will. It's simply good business even if some crook is going to get money from it. They have to pay a legal team no matter if they win or lose. They know that most often the person suing, even if they loose and are ordered to pay the insurance company's legal fees, will not be able to pay. Insurance companies most often hire very good lawyers. It's far too often cheaper to pay out 100K in a settlement than it is to go to court. That's one of the reasons insurance companies seldom pursue fraud for under a 1000 or so. It's cheaper to deny the claim and leave it be than have to have lawyers show up at a criminal court to provide testimony.
