Each state has a little different take on it. As most have said your own insurance takes care of your own medical bills up to a certain limit. Then they and the other drivers insurance figure out who is at fault and apportion the cost. If a driver is uninsured and has at at fault with you then your insurance would still pay your bills and then sue him to get reimbursed.
