Questions on no fault insurance? and John T

Our state does not have it. What exactly does it do? Is it good or bad? My take is no one is held to do for the mishap is it a "licence to kill"
 
"No fault" in regard to auto insurance refers to personal damage to passengers and medical bills, not damage to the car or truck.
Regarless of who is at fault, each person gets his or her medical bills paid by their own insurance company.
 
Jocco, I started an answer but it got so long winded I couldnt even understand it myself so I just quit. In a nutshell it was supposed to reduce insurance costs by saving the expensive litigation fees. Your insurer paid your claim REGARDLESS of fault and you didnt go to Court to litigate the matter. If you caused the accident your insurance company will raise your rates (high risk) but if you were the innocent victim (your insurer still pays your damages) that wouldnt be the norm. Its the same reason our Courts went to no fault divorce, they didnt wanna hear n have to decide all that he said she said crap lol it saves expensive litigation and time

Tell you what, Im sure there are insurance men here and they can answer this far better then I can its NOT an area I practice in. Like I used to tell my kids I JUST DONT KNOW EVERYTHING LOL

Now there's a good idea - no fault divorce insurance!

Sure would've saved me a bunch of money since Texas is a community property state.

Here in Texas the husband leaves the community and the wife gets all the property.

Here in New York we have what is legally titled "no fault divorce." I tried it once. 20 years later my ex-wife still acts like everything wrong is my fault.

Got a call from the Wicked Witch of East Texas shortly after she married my best friend.

She yelled and cussed me because I hadn't warned her about what a sorry SOB he was.

She bankrupted him and kicked him to the curb after a couple of years.

My ex-husband-in-law paid child support until he was 60 years old.

Anyway things seem to be workin' out for her now with the current sugar daddy Peter the 5th.

We have no-fault insurance in Michigan. I'm told that Michigan is the only state that has "true" no-fault insurance. How well it works is debatable, but it's not difficult to understand.

What no-fault intends to do is to separate payments for damages and injuries from the court system. That's not to say that you get away with murder, but it means that when you are injured or your car is damaged you collect from YOUR insurance company, regardless of who is at fault. Now your insurance company may try to collect from the other party's insurance, but that's between the two companies to work out.

What happens if you have no insurance? Then you don't collect. There's no requirement to have collision; if you have no collision insurance and some drunk plows into you, guess what? The most you can collect is (I think) $400. Also, if you don't have "broad" collision, you have to pay your deductible even if the other driver is at fault. If you drive an old car, it's a bit of a gamble because it probably doesn't make sense to buy collision insurance.

There's a "catastrophic claims" fund that handles medical payments over what your insurance covers. I think it starts at $250,000 and the sky is the limit. A few years ago the fund got a little fat and the politicians started eyeing it. The nnalert and GOP were tripping over each other to see who could give it away first. Now it's underfunded and you have to pay a surcharge on every single vehicle you insure. (No multi-vehicle discount.)

One odd thing about no-fault is that motorcycles aren't covered. So if you have a collision with a motorcycle, you WILL get sued, even if the motorcyclist is 100 percent at fault.

The only complaint I have is that the state isn't more tough on enforcing the mandatory insurance law. A lot of drivers make the minimum payment to get insurance so they can get licenses plates, then cancel the policy or let it lapse.

Still suffer from PTDS (Post Traumatic Divorce Syndrom) from the broken marriage.

In the early days of our courtship, Nancy and I went grocery shopping at a local grocery store here in Dallas one night.

I rounded the end of the isle and came face to face with a woman that looked exactly like my estranged wife.

Frozen like a deer in the headlights, I screamed like a 6th grade schoolgirl.

Scared the poor lady and embarrassed the he11 out of me.

Wasn't funny then, but I can laugh about it now.
 
Would that explain the bed up in the coupla???? I thought it was there for the great views of NY I saw in your pics, of the post buldings. LOL ;) JayinNY

Got to thinking about divorce insurance; seems like that is what a <a href="http://www.prenuptialagreements.org/">prenuptial agreement</a> covers.
 
I talked to a state trooper a couple years ago. About 20 - 25% of all drivers lack insurance. About 20% lack licences. The drinking causes some of it, but people getting their license pulled for things other than driving ( usually non payment of child support) drives some of it. Trooper told me they don't have enough jails for everybody.
 
You still have to answer to the courts as far as charges related to whatever you did wrong that caused the accident. The difference is that your insurance company covers your losses (medical, death benefit, loss of wages, etc., some residual liability.) Coverage for your car, (collision, comprehensive), towing, rental, uninsured motorist all are optional at extra cost. What it does is keeps every piddling accident out of the court system, as to who is at fault, and thus should have to pay the other guy. That way, hospitals, and other bills get paid fairly promptly. Overall, it works fairly well, if they"d only get some of the quirks out of it.
 
Each state has a little different take on it. As most have said your own insurance takes care of your own medical bills up to a certain limit. Then they and the other drivers insurance figure out who is at fault and apportion the cost. If a driver is uninsured and has at at fault with you then your insurance would still pay your bills and then sue him to get reimbursed.

It means that you dont have to worry about your doctor bills getting paid while the insurance companies figure out who is responsible.
 
It"s made to sound like a good deal, and it IS a good deal for the insurance companies, the lawyers, and the politicians who get the bribes (in this country, we call them "campaign contributions") from the insurance companies and lawyers.

Without no-fault, one of the things you are paying for is to have your insurance company fight the insurance company of the at-fault person to get that insurance company to pay for your damages (so that your insurance company won"t have to pay you). In no-fault states (some, at least) the real-life result that the people not-at-fault report, is that their premiums end up paying their insurance companies to FIGHT AGAINST THEM when they make a claim (so their company won"t have to pay THEM). Then the only way to get justice is to pay again by hiring a lawyer to fight their own insurance company to get them to pay for the damages. NOT FUNNY/NOT FUN. If you have a chance to vote on it, vote it down!
