Unless they've changed the rules since I had one, it isn't an ultralight if it seats two people. They were making a new designation for them back then (maybe 18-20 years ago?) where you wouldn't need a full up pilot license to fly a two seater, but you would need some sort of limited FAA issued license. For a single seat ultralight, there was no requirement for a license, but you were still bound by FAA regs for operation.
