My experience has been its an Act of God. Unless the tree was standing dead or compromised "structurally". Homeowners have an obligation to maintain the grounds. A boundary tree or near boundary tree requires both property owners perform routine maintenance.
The most recent example I can think of a tree being compromised structurally is a large maple was pruned of all its major limbs one side of the tree. It fell over (to the weighted side) when the foliage filled in and onto a commercial building. The owner of the tree footed the repair bill since he performed the tree trimming against written professional recommendation. Granted this was an extreme...shallow rooted tree, wet area, large canopy.
