You're gettin good advice. You have a great idea. You'll need paperwork on it, or the State & heirs will trip you up in about 5 minutes.
My brother in law doesn't want to write some things down, just his family will do the right thing....... Ya. Well, I've forgotten about any of that then. The State freezes it, taxes it, and gives it to the heirs. Even if they would want to do the right thing, the state will hit them with an additional gift tax, and as it's all divided, which heir is supposed to do the right thing now, while the rest don't have to do anything?
That don't work. If it ain't in writting, it won't happen. And my brother in law has a nice family, think a lot of them. But - it ain't never going to happen. Wasn't my idea, I have _no issue_ here, other then - things don't work that way any more. It needs to be in writing.
