I think you missed his point.
E-bay charges based on initial bid price too.
i.e. if initial bid is $0.99 is is less than if you start at $1.00.
Thus if you know ther price schedule you can "skip" out of some of the cost by being a smart consumer.
To your diner example. When we go to a sports bar for Monday Night Football we make sure we order a beer before the 9:00pm Happy hour cut off time. Mug before 9:00pm is $2.00 after $3.50. not stealing just playing the merchants game.
