In NY you can burn anything on a residential property except for food waste. That includes up to 4 tires etc as long as it was generated on your own property and no commercial use. some villages and towns may have stricter regs but that is state law. I know this as I have been a Fire Chief for 15 years and have had the same problem with my neighbors . NYS DEC is usually not much help and don't want to be bothered. Best thing to do is call the FD and tell them it is creating a breathing difficulty with the smoke, they will put it out, but is only a temporary solution.
