As long as the post is able to break in an accident you should not have a problem with a law suit. Not a legal opinion just mine. But that is the intent to have the post break in a collision and not stay put and kill someone. What I have seen done by a friend of mine and I would do too if I were having a problem is make a box out of screw conveyor trough. The trough is aprox.3/16 thick material and U shaped like the shell of a mailbox. He used the cover and flag off his old box.Looks just like a normal mail box and he has the broken baseball bats to prove it.Two broken bats in one weekend! Mounted it on a wood post so it will break if neccessary. Bet it would put a heck of a dent in someones hood though when it broke off! Good luck with a most frustrating problem!
