Around here, the local municipality has to close, condemn, etc. the right-of-way in a public proceeding before a property owner can take control of it ... please don't get me wrong, I'm not saying that they did the right thing, only that different places have different rules. If I were your neighbors, I would have come to you first and tried to figure out what was going on before tearing out the gates. Maybe the city attorney or city council dropped the ball on closing the right-of-way ... please let us know how it turns out.
