No I do not believe the test was flawed. He is a state employee that took a drug test and failed.
To include the letters DOT and insinuate he goes under federal DOT laws that apply to truck driver; railroad engineers; and pilots is where the flaw comes in.
As a truck driver you can not refuse to test. Even if you pass the drug test just having a bottle of CBD or hemp oil in the truck is grounds for a possession charge. If you fail the drug test your employer can not keep you on just by you agreeing to stop using the CBD. You are fired no if ands or buts about it.
