Kieth: first check your state laws on this it generally comes under abandon property and contract law. Yes you may need a lawyer. There have been many posts on this type stuff on here in the past with hundreds of opinions. I am willing to bet you did not have much of any solid legal paper work on it. Hope you have some way of tracking him down and serve him a registered letter or some thing. The short answer is he is most likely in default and you could sell the tractor again BUT pending your state laws you might have to give money back and it might be ethical to do so! Also you will get the next time use a contract have him sign it he has so many days to pay and so many to remove it, or else you keep the money. Yes I have been through this
