JD Seller - A boss or supervisor is still entitled to free speech in a case like this, now if someone ran around telling people about an employees medical condition or some similar confidential information that they had access to solely because of their position as that persons supervisor then it would be a different story. Repeating a story that one of the principals involved told you is not going to get you sued, it is not a good thing to do but it is in no way protected. All large corporations these days have some sort of legal compliance and ethics code and Lawyers at the helm of those departments, I would imagine most government organizations also have some similar scheme in place, if anything, a person who fails to report something is putting themselves in jeapordy of losing their job for not reporting, not vice versa.
