The rear tires could be 40". That was an available size at the time. If they are/were, it would be a rare modification, because I don't think it was factory.
My guess if they are 40" tires is that there was a close call with the original 36" split rims, or they just didn't provide enough ground clearance for cultivating.
Those tires do look awfully all and narrow for a 10-38.
