I don't think eminent domain should be a consideration with a private pipeline. Unless someone already has a ROW on their property, and the ROW owner entered a ROW agreement with the keystone XL. But in that case, you already have a pipe there, why fight about a second one? You would still be entitled to damages and any additional money per the original ROW agreement concerning additional pipelines.
Modern ROW agreements usually do specify prices to be paid for the ROW, damages, and additional pipes. Usually 30-50% of the original ROW agreement is paid for each additional pipeline, and damages are paid in full for each line. Modern reclamation is used, and the ground is double ditched, so that the top soil gets piled separate from subsoil. Locally, the company that does final reclamation and reseeding was a former golf course finishing company. When they are done, the ROW does look like a golf course.
AS long as the route is flexible, and the company pays fair, no one should have anything to worry about. err... this is a Canadian pipeline... I meant nothing to worry aboot.
