From my experience, the lawyers and the courts (judges, etc.) are in cahoots. Remember, these people golf together, etc. It's in their best interest to draw things out as loooong as possible.
So in this case, this thief will get a finger shook at him this time, a stern talking to next time, a slap on the hand after that, etc. until ultimately (sigh) they do have to put him in jail.
