Your berm is more than likely grand fathered in right now. IF you make any modifications to it then it will have to meet all current laws and rules. So if you remove it you just lost it. If you have flood insurance and want to move then tear it out. Reason being if you flood and have more than a 50% loss with the Federal flood Insurance ( That is the only kind you can buy too) they will condemn the property and you will not be able to repair it.
