Depends on who the sheriff/cop is. Why did they charge the homeowner? Being a retired cop and making a few of these types of crimes/burglaries my advice to the homeowner was to NOT talk to the police regardless of how "guilty" it made you look. Given the chance, pick up a phone book and call an attorney and keep your mouth shut. You will be glad you did. If it comes up in court just say you didn't trust the cops or you were in shock. My brother shot a man in the rear in Ohio in 1964. The man (burglar) was surely injured. Sheriff said don't worry about it. End of story.
