Don"t ever believe the Ebay nonsense that bidding on an item is a legal and binding contract. That is just pure BULLONY. After trying unsuccessfully through Ebay to collect on several nonpaying bidders I contacted an attorney that specializes in interstate commerce. Here is what I learned. Ebay is not only a paper lion but toothless as well and here is the short version as to why. As long as Ebay knowingly allows sellers to sell an item locally and remove that item from auction before the end of the aution there is never a true "meeting of the minds" between seller and bidders which is required in any true contract. I no longer waste my time bidding with a seller that threatens legal action for nonpaying bidders. If you are selling on Ebay just accept the fact that there are morans out there and sell to the next highest bidder and move on.
