Why, tell me why must the world have so many "a"holes in it? My wife, parents and myself farm on lease to own, my grandfathers farm, mothers side of family. Mom has three brothers, she is the oldest. Moms brothers HATED the farm untill 2 yrs. ago when we started renting it. Grandpa is now 90, it was time to hand things over...When we started renting everyone (moms family) got real interested in the farm. Then they found out we are leasing to own. now they want farm chopped into 4 pieces, "because they want a peice of thier heritage"., unless it sells for well OVER development rates. Seems that enough money will buy them out of something they never wanted till now....We are paying above average rent, and will pay above average price for local farm ground when we finally purchase. Grandpa wants the farm to stay a farm, and knows we can do it. (we basically ran the farm for him last 5 - 9 yrs) This is just background info for my real gripe(s). Sunday, my cousin comes out to the farm, and without asking, no permition whatsever, starts target shooting 30/30 and 30/06 and various handguns. His target was plywood nailed to a fencepost. His backdrop was a small grove of hedge trees, about 45 yrds. away. He was shooting into the wind. PROBLEM(S) the grove of trees in the pasture is where our cows were pasturing, doing there own thing. I guess w/ the wind, the sound was carried away,and the noise didnt scare them. When i confronted, i was told what a M.F.'r is was, to leave him the "F" alone, and i didnt own the G.D. F'n farm and he could do what he wanted. Grandpa went out and ran him off, THANK GOD no cattle were hurt. Then monday, same cusin comes out and wants to dump wood chips from his tree trimming Buisness, and concrete chunks in my PASTURE!! I didnt let him in the driveway, and said not to come back, or the law would be called. Whats next??? I feel better now, some people i tellya. Sorry so long.....

I'm with most of the posts. If it isn't 200% iron clad, in writing, notorized, copied, witnessed and signed in blood, you will be in court for years and probably loose.

Get gramps to set a price, borrow the money, and get is bought now!! not next week as he is 90.

Here's a little advice that you won't hear from others- you are better off buying or leasing to own from someone other than mom/dad/grandpa/family. It always gets ugly- never seen when it didn't if there was more than 2 parties involved- and everyone will always feel like they got screwed.

If you dont own this land clear title BEFORE he passes on, you will never own it. All your sweat and time will be down the drain; even your health from all the fighting with kinfolks. Purchase whatever land you can afford now, all legal and proper. Tom

Looks like the only way to keep the farm is to have grandpa sign the farm over to you. Since it is his farm seams like he can do what he wants with it. Stan

I appreciate all the advice. Fortunatly, since mom is the executor of the estate, and Grandpa has been planning ahead since I was 8 or 9, now 23, everything is in a trust and has been for sometime. They (mom, dad, grandpa)recently (last spring when lease to own deal started) updated the living trust and will. Everything is currently up to date, and last winter we sat grandpa down w/ video camara and i taped him and mom discussing his wishes on how things are to be done and why. Mom talked to him about current events and past events over the years, from his child hood to the 3 seas, to WW2, (grandpa was in both)and numerous other events to prove his mental stability and capability. All on tape in fire proof safe. Best we knew to do. I KNOW that this will get alot worse before it gets better. My short (long) rant is only a 2 day insight in to what goes on weekly, or more often than that....Fix barn up, "you have no right"....Fix up or build new fence, "who said you could do that?"..."can we borrow equipment?", then it comes back broke w/ no fuel in it, Equipment borrowing dosent happen anymore due to this.

You guys are insightful, and knowlegeable. Any other ideas on what to do now? We want to leave the farm in grandpas name untill his passing, so he owns it the rest of his life. That has been the plan from the beggining. Also, with just starting a buisness, Electrical Contractor, I am not quite ready for the farm mortgage....You guys know how that goes....Thanks for all input and understanding!!! Sparktrician

My dad transfered title to his farm to me before he died,but kept a lifetime interest in it.That means that i could not sell it,or remove him from the house even if i wanted to.

When my dad was 18 his mother died in the flu epedemic 1918.No will.My dad wanted to stay on their small farm but he had 2 brothers and 2 sisters who wanted fast money and refused to take payments from dad.It was a small place, about 15 acres brought little money .Dad had a hard time during the depression as the WPA projects hired only married men.Dad and his brother in law managed to buy back 2 acres each on the home farm around 1935 and built small homes.I bought another acre in 1958 and built a house.I had plans to buy most of the old farm back but an intersate highway changed that.You need to buy the farm from your grand dad now.Give him cash payments and the right to stay on the place for his remaining years.A lawyer can handle this and keep the relatives off your back.You grand dad needs a will right now.relatives show up like vultures when some one passes on and start grabbing things.My uncle gave my son and I each a nice double shotgun just before he passed on.He said he could be sure we got them that way.

Get to an estate lawyer and have it put into a trust for your benefit as soon as possible. Make darn sure you can prove there was no undue influence on your part- get signed testimonials from your grandfather and others stating his intentions and wishes. Make sure they include that his mental capacity is fine. A trust is more difficult to attack than a will, and avoids probate which can take years to settle. Good luck. Kurt

If you are "leasing to own", get the agreement in writing. Best would be if you could sign the purchase agreement and get a mortgage now, even if your grandfather holds the mortgage instead of a bank.

...oh yes, oh yeah, WHAT A FAMILIAR EVENT.

Next door neighbor died, and i wanted to purchase the 17 acres of ground off of his one cousin for 100,000. Next thing you know, there are MORE COUSINS walking around the place, SOME OF THEM DIDN'T WANT ANYTHING TO DO WITH MY NEIGHBOR WHO DIED. When they found out he died, here they come in their BMW's and start strutting around the place, hopping up on my tractor and asking ME who owns it.

I was going to get the shotgun if they didn't get off my tractor, I should mention...

eventually, the cousin who inherited the place gave in to the other retarded cousins and finally wound up selling the place for 265,000 to someone else.

There went my cattle business, down the drain.

Fast forward 3 years, and there are F*CKIN MEXICANS, 30 of 'em, living in the house my deceased neighbor loved.

My MIL had two ajoining farms--one 180 and one 80 acres. We bought the 80 and my BIL bought the other while MIL was still living. She wanted the farms to stay in the family and if the other five sibblings got mad, they could be mad at her. Fortunately, there was enough in the estate for the others. Same thing. None except us and BIL had any interest in the land until it was up for sale to us. Then everyone wanted more for it. We bought 80 acres--no house, buildings, etc. for 18,000. Not gerat farmland, but it's ours and it's still in the family as MIL wished.

Had trouble with one BIL and nephew hunting. Scattered bait everywhere and cut shooting lanes and left punji stakes for me and my dogs. They don't hunt here any more.

Your cousin is trying to stake a claim to the farm. Not that he wants the land, mind you, but he knows what the property is worth.

If you do nothing, I can pretty well guarantee what will happen. When your grandfather passes on, cousins will come out of the woodwork and even if your purchase agreement holds up, you will go through more aggravation that you can imagine.

This is a pretty clear case where you need professional assistance. Ask around for the name of a good lawyer who specializes in estate planning. You need to make sure you have an iron-clad arrangement with your grandfather. And don't put it off; even if Grandpa lives for many more years, your cousins could later claim that he was not competent to make decisions.

Some family arent worth a &hit. I have a sister-in-law that actually called up her grandfather and asked for "her" inheritance now, cause she wanted to buy a new car. Even though her 88 year old grandfather is still breathing and coherent. SIL also got a 1998 Ford Explorer truck for Free from her mother (it was my FIL's truck) FIL died from cancer in 10/2006. SIL didnt give my MIL one dime for the truck, easily worth $5000. What scum. Makes me sick.

Good advice there. See a lawyer and sew the thing up tight with Grandfather's signature.

Otherwise the entire deal will end up in court, your legal fees will cost more than the farm is worth and you will end up with nothing.

i cant believe the nerve of some people. One of my "friends" came over and asked if he could drive my wheelhorse. Sure, why not says i. I go back into the shop and come back out about 10 mins later just in time to see him come crashing through our TILLED and PLANTED field and run down a small tree we planted. Third gear, wide open throttle. OH @%&( says i, assuming the clutch is loose again. I start running after him and he sees me and stops. What the hell was that??? "It'll grow back". Stupid tree was split at the base, and to nobodys great supprise, he refuses to pay for it. Not to mention the drive across the field he took. His parents wont answer my emails so my mom is making me eat the $60 for a replacement tree.

Today,"heritage" means inheritance of something they can sell. I know the same thing going on 4 miles from here. Dirt poor, and I mean dirt floor poor gent has 160 acres, he rents it out. All the nieces and nephews hunt it everyfall, and are waiting for their fair share when the ol guy passes. Not one neice or nephew will visit on holidays, stop and visit, or do anything for the poor old fellow, they are all town folk. I bet they even have their phone programmed for an appraiser and realtor for the 2nd they get the call that their poor, poor uncle died.
