Today my honey and I went to a furniture auction at a place that was closing up shop to furnish the apartment we're moving into in 2 weeks.

Stuff went rediculously cheap and most of the stuff didn't even sell, so we bought a new couch and loveseat, a table, rocking chair, 3 pc. coffee and end table set, a secretary's desk, and 1 single chair that matched the other 3 my brother gave to us.

We packed up and got home by 4, and we were gonna back it up to the garage to store it rightaway but we went to my nephew's 1st birthday party first and decided to do it later.

Around 5:45 I went out to get the stuff which I parked in the farm driveway, and went to back up to the garage on our house. We live on a busy highway and the speed limit is supposed to be 45, but no sooner than I got onto the road when it was clear, than my trailer got hit by a teenage girl who just got out of work (works at the local Ace hardware) and had to baby sit in 30 minutes.

She said she didn't see me, but it's hard to beleive that when I had my hazards on and the road was straight and clear. I stopped when I saw her coming and she wasn't slowing down, thinking she was gonna take the shoulder or the ditch, but she hit the left rear corner of the trailer and then hit the ditch. No skidmarks to be found, no squealing, nothing. Did I mention she was driving a late 90's MUSTANG?

I got a $160 citation. I didn't bother sticking around to see what she got, I was getting cold so I went back in the house to cool off. I'm gonna talk to my brother who was an insurance agent a couple years ago and take some pictures, etc... What really sucks, is that techmnically it's Dad's truck yet and under his insurance, so it's gonna affect his insurance, my insurance, and I'm gonna haveto fix the trailer plus take time to go to court to see if I can get it reduced or dropped.

The 3 pc. coffee/end table set took the brunt of it and got damaged, as well as the back of by trailer. The trailr itself is fine, but the wood sides on the back and the tailgate are pretty much gone on the left side.

Now I'll have to make a tailgate like I was thinking about making, that folds in half and makes a ramp to drive stuff onto the trailer.

Fight it in court.Get a court order to obtain a copy of her cell phone bill to prove SHE was unattentive driver NOT you.

Like someone else said,she seen you,but her brain didn"t get the message "cause she was yakin"n on the phone.

Take lots of pictures of road too.How much you wanna bet she has you made out to be the "bad guy" to her insurance and parents?? Get ready and good luck.

Well, her dad was quite pi__ed when her parents showed up, so I just stayed away. I'm sure there isn't any way she wouldn't have been on the phone.

Just be glad that your alive. Living in the area that you do, that's quite an accomplishment. I've been all over this country and the area between Green Bay and Oshkosh without a doubt has the highest percentage of self centered, arrogant, moronic, get out of my way, I'm comming through idiots in the country. Your lucky that she went into the ditch otherwise, she probably would have backed up and tried it again. I live about eight miles west of Appleton and I just hate it when I have to drive in that area.

My opinion is based on the second set of circumstances described lower down.
Assured clear distance is a term used to describe the spacing between vehicles (or obstacles) You were performing a complex but normal task in the operation of a licensed vehicle. no different than any delivery truck or trailer rig delivering material in that setting.
In every case from the moment you slowed down (with brake lights on) to the moment the rig would have been actually off the road in your driveway, she would have hit you as she was not maintaining assured clear distance, and failed to assess her closing rate and did not integrate the blinking hazard warning lights into her actions. Though you were blocking the road, you were technically leaving the road for delivery purposes.

Ask this! If you had pulled into the driveway "front first" and slowed such that the trailer and load were at a reasonable speed to make the driveway corner, and had your turn signal on would she have hit you. Probably. The most reasonable action on your part (having assessed the visibility and low traffic nature of the rural setting) was that which is expected.

If it had been a bread delivery truck, or a handicapped transport vehicle turning around in that driveway, would they be at fault?

All things aside, and the fact that my daughter just started driving with a permit and a parent. Thank Gog yourself or the young gal got injured, or worse. My daughter does real good on about everything, but she has has a bad habit of not really slowing down quickly when some thing is going on up ahead, it's like shes afraid to just hit the brakes and slow down, RIGHT NOW, she lets the vehicle coast or stays on the gas till the last second. If she wants her licsence she is gonna have to change that bad habit. Again, what happened sucks, but remember it could have been far more tragic!

She was probably yakin on her cell phone and her eyeballs may have seen you but the message didn"t get to her brain cause it was tangled up in the cell phone conversation.

I hit a car that was completelt STOPPED in the road on a terribly foggy day--no one was hurt as I was only going about 20 MPH due to the fog. Other party was outside of his car scraping his windows due to no defroster---he was stopped in his lane right on the road. I got a ticket for "failure to maintain control" of my vehicle. I fought it and lost, but judge reduced the fine to ONE DOLLAR and told the sherrif he should have had better things to do than ticket me on a technicality when the other person had stopped in the roadway on a foggy day.

Since the weather was clear, you may have a case.

Just a note. If that car had ABS (Anti-Lock Brake System) then there would be no skid marks no matter how hard she pressed on the brakes, assuming they are functioning properly.

Ok, I'm having a little trouble following the senario, BUT, in Illinois if you hit anybody in the rear, it is automatically your fault. Driving too close, failure to have control of your vehicle. Fight it. Chris

She probably didnt see you. Like the one that pulled out it front of me, she was probably on the cell phone & wouldn't admit it. Anyway I don't think there's any such law as unsafe backing. I'd have to see that in the books. What happened to failure to yield the right of way? Cops write tickets by the seat of their pants lots of times & they almost always favor young girls. A woman cop did that in my case. I wished I'd ask her if she was related to the girl.

What is on my ticket is statute # 346.87:

"Limitations on Backing. The operator of a vehicle shall not back the same unless such movement can be made with reasonable safety."

I'll have to do a little more digging, but I think I may just have a case. The road was clear, and the lane she was in, I can see for over 1/2 a mile. Probably closer to 3/4 of a mile. I saw no cars coming and I pulled onto the road from the farm driveway, where I was parked, and drove up to the house driveway where I was backing up to the garage. I wasn't on the road for more than 30-40 secons, and all of a sudden there's a car coming that isn't stopping.

If I do my math right, 3/4 of a mile traveled in 40-45 seconds would be about what speed? 60-65 MPH in a 45 MPH zone? Doesn't sound right.

in that case speed caused the accident, not you. But she's not going to admit to speeding & you can't prove she did. If there was nothing in sight it was safely reasonable to back. She is required to stop for any obsacle in her lane. I'd fight it - good luck.

Don't exactly understand if its her fault as you say why you got a ticket.Did you have lights on the trailer everything legal etc?

The lights were fully functional, as I re-wired it this summer. I had my flashers on too.

I got a ticket for unsafe backing.

At least you nor your lady friend are hurt. By the sounds of it that is pretty amazing no one was creamed based on the fact she did not even have skid marks.
