OT: Cracked auto glass responsibility?

Hi folks,
Sorry so off topic, but I need some advice. I was driving a country road last weekend, when some young man (a minor) pulled out in front of me. I had to really get on the brake pedal of my F250 to prevent hitting him. He had been shopping at the roadside fireworks stand, and when he accelerated away from me, he showered my truck with mud and rocks and cracked my windshield. Its a small starburst crack right in the driver's field of view.

I chased the young man down at the next stop and told him that he had cracked my windshield and to pull over. I obviously scared him quit a bit as he was on the phone with his parent, but he was polite and gave me his insurance info.

I called Geico, his insurance company, and opened a claim ticket, but they called today and denied my claim. I'm not sure what to do. I have a good sized discount on my Farm Bureau policy because of no claims (as well as a $500 deductable). I'm guessing that it'll probably run $300 to replace the glass, and I'm guessing no one will fix it since its in the field of view. Any ideas?

Years ago, I was driving down a four lane highway when a local dirtbag pulled up beside me and waved me over. I pulled over and he said that my vehicle had kicked something up and broke out his windshield. I looked, and it was broken-not just a pit or a crack, but an actual hole about 1" in diameter that went through the windshield. Suffice it to say that I was a bit skeptical that my vehicle had just kicked up something that had caused that much damage; I still suspect the guy was just looking for someone to buy him a new windshield (I was driving a brand new mini-van with intransits at the time).

I gave him my insurance info and turned it in myself. An adjuster called me and said that this is classified as "road hazard"; it is up to the insurance carrier of the vehicle that is hit with the object to pay. She said my deductible for glass in this situation was $50, if it had been my vehicle that had been hit. I doubt the other guy had insurance. I never heard back from the guy; the adjuster said she was going to call him and break (excuse the pun) the news to him.

Never understand why you guys have $500 deductible I have $50 and none on my comprehensive it cost about $50 more a year that would take 10 years to get back my $500 I'm sure to have something to collect on in 10 years so it all comes out in my favor and I don't have to worry about coughing up the big bucks for a small fender bended. I have been with State Farm since 1968 so I'm pretty much a preferred customer by now. I also have my house, cows and everything else though them that helps a lots. I see auto glass companies wanting to fix your windshields for free no deductible.

Call the P.D. that covers the location where the incident occured and make a police report on it.I know you think that is drastic but if you want to be reimbursed for the glass you will need the report.Don't know if it will help but for future reference you should do it on the same day as the incident. You could take it to small claims court as a last resort.

10-12 years ago I had a comprehensive claim due to hail damage. It did affect my premium at Allstate.

Turn it in to your insurance. It goes on Comprehensive, not Collision. Should be no damage to your record for a Comprehensive claim. Same part of your insurance that covers fire & theft. Often there is a much lower deductible on Comprehensive than Collision.

Give all the other guy's insurance information to your insurance company. If they think he should pay, they can file a subrogation suit against him and his insurance will have to pay.

At least that's how it would work in my state, your's may vary.

Your on your own,he doesn't have to pay.The only way he is liable is if something fell off his truck and struck your windshield.Anything on the ground,stones,rocks,anything that is flipped up is not covered.Your insurance company should replace it at no cost to you,no deductable,and
no premium increase.

I use to wrok at a glass shop and we had cases like this all the time. Well if he did spin the tires and a rock his the windshild then he has to pay for it. Now did it crack the wind shild or just chip it? And you said its right in the drivers field of view the glass shop cant fix it. If thay do there will be a glare and you wont see where your driveing.If thay do fix it and there insurance finds out man oh man there gos there insurance and ever thing else. His insurance will have to fix it thats just that. I dont know where you live at and what year the truck is. Its hard to say how much it cost. But hear in town it woud be about 150 200. And watch out who does your wind shild to. If thay dont do it right and you crash the truck the windshild is sopost to say in well if thay dont do it right it will fly right out. I Have the paper that says im a regsterd auto glass repair. I shure wish you luck.

Stephen,
I`d check with your agent, what I was told by mine was that they will jump at the chance to fix a cracked windshield. If you have any glass coverage, they usually waive the deductible and having it fixed doesn`t affect your discount.
I think they look at it like it actually prevents larger claims caused by an obstructed view. Hopefully that`s the case for you.

Most insurances have full coverage on glass with no negatives on your insurance. Call your insurance and get it replaced. Don't try to fix it if it's large or in your line of vision. The fix is ok but you'll still see it. I know. I fixed one on my truck and had a pro fix one on wife's car...it's ok but not perfect.

The insurance most likely denied due to the object coming from the road and not off the vehicle. Check with your insurance company if you have full coverage with glass they should cover with no deductible. Subject of course as to your policy. Also check with local auto glass repair companies as there are fixes for chips and some cracks that don't require replacement of the windshield regardless of location. Just looked into replacing my 97 F250 windshield (cracked all the way across) and will run about 225 - 250. Could also talk to him and his parents about paying after getting at least a quote for repair or replacement. Many of the repair shops will bill insurance for you unless you say otherwise.

I suspect his spinning tires tossing a rock into the windsheild is no more an act of god than him picking up a handfull of rocks and flinging them into your windsheild. I guess proving it might be another matter.
