Well about a week ago I asked about what you would do if some one wrote you a check then call you and said its not any good. Well as I said he called and said he would make it right, but then on wednesday he called a gain and said he would not be able to cover the check which is ok since I still have the tractor. Well now today I get a thing from my bank that says I'm overdrawn for the amount of the check, so now what in the world do I do?? I plan to call the bank monday to see whats up with it since I didn't write any checks on that money so how in the world am I over drawn by that much. I think I maybe looking for a new bank soon.
Thanks just pissed a little right now

Old; Did you get your problem resolved with the bank.
I am interested not in any thing presonal but just in case something like that should happen to anyone me or anyone else.

If you get charged any bank fees bacause of hisbad check ,take the bad check to your local states attorney and let the state collect it for you ,I love ILL's bad check laws bacause they can award you 3x's the amount of the check . a local gas station owner loves them bacause a 20.00 bad check usually turns into 60.00 for him

Hey old why didn't you just go to his bank and try to cash the check? If you had doubts about the check in the first place it would have been over and done with right then and there. You can probably get you money back but it could take awhile. I know hind sight is 20/20, hope it all works out. Jim

Is the bank a big, national one or a small local one? Is there someone there you deal with on a regular basis, or maybe some people you know? I get PO'd at my bank once in a while, but I just call the loan officer that I've done business with for many years or neighbor lady that works there and ask what the heck is going on and they say, I'll take care of it. I think that the bank might get charged when they send out an returned check and they are trying to get their money back, but if you called them when you found out it wasn't any good, that should get you off the hook. Be calm and firm and ready to change banks. The smaller the bank, the easier it is for everyone who works there to know you. 30 some years ago, I banked at a small country bank that would call you if you were overdrawn and ask you to come in and sign a note if it would be more than a few days before you could make it good. When you go to see them, try to keep your cool... girlfriend used to work at a bank and someone came in all hot and nasty... by the time it was over, they closed all his accounts for him and demanded immediate payment for the loan on his house.

If you are reasonable with them, and it was indeed their fault, they will take care of it.

Bankers can be a pain and I have been frustrated with them too. It costs them money to get new customers and they don't want to lose you. They'll fix the problem.

did you deposit the check in your bank? you didn't write any checks against the $ 3000 sounds to me like somebody at bank has lot of -splanin to do.

Yep he was right here at my house and wrote me the check. He looked at the tractor said he wanted it wrote the check told me he would have to get with his brother in law so haul it. Then sunday he called told me he had bank problems so the check was no good but said he would bring cash later that week and pick it up. Then on wednesday he calls and said he couldn't get the tractor. Bank called me thursday and told me the check had came back as being bad and I told them I knew and had called them the day befoer to let them know. Then today I get a card saying I'm over drawn by the amount of that check but I never wrote a check to pull that money out not even for as much as a dime of it but yet they say I own them and they will charge me $7 a day for being over drawn, plus charged me $60 service fees to boot for the check being bad.

Sounds like you got hit by a scam. Go down to your bank and talk to them face-to-face. Have them show you exactly why they think you're overdrawn. You may need to get the police involved.

Here's what might have happened: They give you a bad check, which you deposit. Then, knowing that you have $3000 in your account, they make a withdrawal from your account in the amount of $3000 before their check bounces. Now you're short.

If the bank was negligent in getting proper ID from someone withdrawing money from your account, then they are liable.

One last thought. You wouldn't happen to be missing any checks? Take a look in the back of your checkbook. Not that they need a check to get money out of your account; knowing the account numer is sufficient.

I had something similar happen many years ago, when banks didn't require IDs to make deposits. I received my bank statement, and there was a deposit I didn't make. Someone got my account number and made a deposit to my account. The check was bad and they took cash back from the deposit. The bank made good on it, but they sure dragged their feet.

Got a bad check, take it to the police. If the person who wrote the check knew it was not funded then its a criminal offense. Best way to deal with people writing bad checks.

Unless you live in Montcalm County Michigan. The prosecutor won't prosecute for bad checks here. They are so broke,they have to choose what crimes they will persue and which ones they won't. Honest to God! I can't see how in the world you could be overdrawn for that amount though. Somebody hit the wrong key or something. I switched banks 26 years ago,closed my accounts at the old bank. The branch manager told me how much to write the check for to close the checking account. Next day I got an overdraft notice. Took it right in and threw it on her desk,she said forget it. I never advocate getting mad instead of calmly discussing things,being on the recieving end so often,but when it starts out calm,sometimes you have to escalate things. Good luck.

rrlund where you at in Montcalm County? I'm up in the Edmore area. In Andrea's defense, she's had some pretty high profile cases to deal with lately. Yeah, that doesn't excuse the oversights on other crimes however.

The bad check isn't whats bugging me but that the bank says I'm over drawn for the amount of the check and as I said I haven't written any checks off of that money because I wasn't sure it would be there
