1992 Buik Roadmaster Limited that we got got from my too old to drive stepmom.
Garage kept new tires and transmission. Really nice car. Wife got slamed in the rear by a new Mazda Sport Utility that just left the dealer lot. They will toatal our pride and joy car but are only going to offer book on a 92 with just over 100K on the odometer. Any way to maximize on what they will give? My wife is a little stiff and will get checked out but we don't want to milk a medical claim. I would like to milk the claim on the car because it was mechanically mint but has a low book value. Are we just screwed?

Specialty/hot rod/ classic insurance covers what special vehicle is worth on collectors market. if somebody hits it the classic insurers want full value from other parties insurance. Illinois years back a body shop that did old classics had one of their projects hit- other insuranc company refused beyond scrap value for old car, classic company paid full value to restore or replace then charged driver with financial responsibility /uninsured and had state start to pull license for non payment of damage plus civil court filing for full damage plus legal costs and other insurance company got complaint with state request to pull authority to sell insurance in state. Settlement was day after judge said suit goes forward, license pulled pending outcome and insurance company to be charged with civil fraud. classic car insurance company said they give 1 conference meeting then they go to court. not cheap, but 48 Buicks are hard to find parts for when they get hit. Wow, Thanks for all the replys and concerns! I had her go to the Doc today and your guys were right,she got twisted up more than we thought. They gave her two prescriptinon and signed her up for physical therapy for a few weeks. Personly I think she will be OK but better safe than sorry later. I guess in hindsight it's just a car and we will get her a better one than she had. I have to admitt I can't help teasing her a little about getting the toataled car back and cutting the rear end off and mounting a pick-up bed. It's a shame to see such a nice car go but it got hit on the right rear and pushed the trunk lid thru the back glass and just pushed the whole right side foward jaming the doors shut. I'm sure glad she was in the RoadMonster as we called it and not in a small car.

Don't let them try to pull one over on you. My son had a woman back into his car. the insurance said the accident was 15% his fault, becasue he did not honk his horn before the woman hit him. and they only paid him 85% of the claim.My son was forced to settle, he needed his car fixed. If you can do without it, stand your ground. If they do not want to pay to fix your car, you can force them to replace the car with one in 100% like condition.

I know you wont like me saying this but the car is only worth what someone will pay for it. A 1992 roadmaster buick with 100K miles, $6,000 maybe. Must have been a real bad accident to total a large car like that?

Remember one thing. No insurance company is your friend. They may call and pretend to be concerned about how she is feeling etc. What they are trying to do is get you to say she is okay.
Been there, done that. NEVER trust them. They are in business to make money.

And others here are spot on about the car. A neighbor of mine had his own agency. He told me that if you stick to your guns they will eventually settle to get it off their books.


Hope the wife is ok.

Tell them you want a replacement vehicle that'd your right they will talk turkey then. don't settle to fast the longer you take the more you can get.

I just went the the same thing with my company on cow that was hit we settled for what we wanted not what hey wanted to pay.

get the wife checked out. just because the xrays show ok dosn't mean that she dosen't have soft tissue/muscle damage. motorcycle wreck on Oct 8. went to the doc for road rash off work one week. went to chiroprator two weeks after to get checked out even tho felt good. problems started showing up about 3 weeks after. Jan 4 back let go. MRI showed 5 bulging disks and will be starting back to work part time next week. This is after 20 sessions of spinal decompression therapy and exercises at home three times a day.
SO DON'T BE IN A HURRY TO SETTLE

For what it's worth, I had an accident 2 yrs ago. I rear-ended a car with my 1995 F150, blew the airbag and transmission.Had the truck towed home as I had diesel fuel tanks and tools in the bed. Got a car to run around with while adjuster worked out a settlement. Two weeks later, the adjuster showed up with 12 pages of 1995 F150 trucks offered at dealerships and private sales. Settled for $7000 then bought another (as is with far less mileage) for $4500.Paid $65. to get it saftied. First time I was ever treated that way and sure couldn't argue with the way they based their offer.

Every situation is different. In my case, my daughter was hit in the rear by a car that was covered with a different company then mine. When I drove the car to their adjuster, he asked me if I had received the $300 check. I asked what this was for and he said it was a frenge benefit for our trama. He asked me how my two children were and I informed him that both had a doctors appointment that week. They had "dental appointments" which I did not disclose. He made me an offer to repair the automobile and I refused and stood up. I informed him that we would settle later. My final offer was considerably more then book value and I drove the car home. Oh-- I got the $300 check and it had something about settlement on the back where I was supposed to sight. This was many years ago and I may not have told the many details that led to this settlement.

Go to a DR right away.I was rear ended back in November and I was fine for about a 5 days.Neck pain started and I'm now suffering.I hate going to Dr. for anything.I didn't go to the Dr. till 8 days after the accident,talked to a lawyer and he said it was to late,Insurance co. won't believe it because I waited to long.You have to document everthing.

Couple of the guys got it right--the insurance company has to satisfy you and they're doing the easy way.
1) hold out for what you can show/believe is a fair value.
2) you might look the car up in HEMMINGS for the value. You might also ask/call around for a classic car appaisor. A mint condition car that old is worth more then "blue book".

The adjuster in paid to low ball the settlement. Hold outs just don't clear his plate may take a few months for you to work up a couple pegs in the structure. Pain and suffering will come into play with so call blood sucker. Your iron is book value and that it for the most part. My only settlement for a total was so good I just took the check and run. Leave the medical claim open for a few years to see if lasting problems show up.

Years ago one of my step-daughters hit ice and rolled my S10 Blazer. Went in the ditch on 4 wheels BUT when she hit the hardpack from the snowmobile trail it rolled. Broke the rear axle and landed on it's top. We had American Family. Their first offer was a joke. Rufused it. No rust, motor was good and new tires. They kept telling me that their offer was fair. He told me he could replace it with a different model. Told him I'd like 2 then (I had 2 drivers sharing this one). He told me that they don't seel cars....We waited and dealed some more. I got to keep my tires...Put old ones back on...Anything that was easy to remove I could take (floor mats and jack). They finally gave us a check that was OK..They had to pay storage while we discussed our claim. Wife cashed the check. We had a call from the insurance company that (someone from upper management) our claim was too high...Too bad we already cashed the check. We had 5 Suv"s and trucks and our home insured with them. So just keep dealing...remember they are in the business to make money..

If it's the other guys fault,it's his insurance company you're gonna be dealing with,not yours, at least that's the way it is in this state. Also your wife needs to get the full treatment,mri,catscan,threapy,etc.etc. And your car,I would keep raising cane until I was satisfied.Leave no stone unturned.

I've known some other folks in a similar situation with a car that is actually worth more than book value. They carefully read the fine print in the policy, and found that the insurance company was obligated to either repair or replace to original condition before the crash. They made the insurance company find them an identical car in similar condition. Might work?

I would try my best to work with the adjuster. A lawyer will just aggravate them and by the time the lawyer takes his cut you many times end up with less.

A good adjuster should treat you right if it was their fault and they know you are not trying to milk the neck injury. But by all means do make sure the injury is taken care of. Go to a real doctor, not a quackapractor

It is a problem with an older car that is in mint condition, as the book assumes all cars are average.

With a car that old, the insurance co will total it just because it will cost more to fix it than the blue book shows it is worth. If you want, you can negotiate for a reduced settlement and keep the car. Depending on the amount of damage, you might look into buying the salvage and having a body shop repair it for you. I drove a "totaled" 85 Suburban roll over for 15 more years and a VW Rabbit diesel that was "totaled" twice (made money on that car) then sold it after 4 yrs and two teenagers for more than I originally paid for it. If you know a good body shop they can cut a whole rear end off one car and put it on another. The biggest proglem is if the frame was bent. That leads to many problems with alignment and tracking of rear differential. (Just my experience after 8 yrs working in "auto recycling business")

You could look around and find out what a cream puff like you had actually sells for. Then ask them to pay that price. They really do have to satisfy you after they get done huffing and puffing. They can be nice or they can be rude depending on what they think will work. You should do the same - explain "the difference between the easy way and the hard way" to their claims rep.

Unless you have no other way of replacing the car than getting the settlement, wait. Make doggone sure your wife's neck is ok - and this is not to milk a medical claim. A sore neck can be a long-term problem.

What will your insurance company do for you? If you can settle better with them than with the other driver's company, settle with yours and let them subrogate the claim (collect from the other company).

If you have recent records/receipts for new tire and transmission they may help up your claim. I've "heard" that from other people but can't personally vouch for the correctness. Any potential to sell direct to a rebuilder, or part it out?
