O.T. Ebay tractor purchase

Anyone ever buy a tractor or anything else on ebay and the seller refused to sell it to you. I am talking about a (no reserve) auction with a starting bid that was met. We were told that they would sell us the tractor for 10 times are bid though. Besides negative feed back what else can a guy do?

This is what I was told by a lawyer about the same type of deal, only it was regular auction not Ebay. Any purchase you make or item you sell has 3 business days for the transaction to be canceled. Also if no money was exchanged there is no legal contract. I said the heck with it and ended up buying a better tractor for less. As for the lawyer I presumed he was up on the laws, took his word for it and walked away. Good luck.

Well, it sounds like you were getting a great deal and the seller didn't know what he was doing and how to set up the auction. As far as some responses say this is a legal binding contract, not so. Where's the contract, where's your signature. Look else where. There are alot of good ebayers out there. I really pay close attention to the feedback and go with my gut. Good luck! Craig.

Well how about the A$$ that dont comeplete the sale one there,I had a Guy buy the item come look, had to call a friend just to see if there were any parts for it if it may need any,[he did that and just drove away and said nothing ]then there are the one"s that Want To Buy Parts Off what you have for sale,Wait till it does not sell and Wright 2-5 minites after the sale ends,This Realy PI$$"s me off,I dont have time for LOOKERS or Dreamers.all I can say is PLESE READ HOW IT IS listed it will save a lot of problems for both sides.

Ok, thanks for the help guys. I think maybe he may of just not understood how ebay works and didnt know about the reserve price that could of been put on his item.

I think I remember tripping across a tractor just a few days ago and thinking that the fellow kinda seemed new to ebay and really wasn't "protecting" his auction.

We all gotta start somewhere, I guess.

Unfortunately, theres not much "practically speaking" you can do other then the standard flea bay remedies for leaving negative feedback. The operas not over till the fat lady sings and until something is actually bought n paid for theres no real deal at least economically speaking. One thing I learned early in my small country law practice was its hard to make anybody do anything anymore regardless of what some law may state and the laws favor the bad guys it seems.

Ive been there a time or two, Nothing as big as a tractor. The real bottom line is that if the seller refuses, there isn't a whole lot you can realisticly do. Just the same as if a buyer refuses to pay. Lawsuits would cost more than they are worth. If you send him money without being able to get your hands on the tractor, you are probably out your money, unless you are willing to sue. Ebay won't help

If someone would jerk me around like that, I would be GLAD not to get the tractor.

If they are not honest in their ebay dealings, I would wonder what else is "fishy" or misrepresented with the tractor.

You're not out anything... RUN, don't walk, away from the deal.

You can file a fraud complaint with fleabay and threaten the seller with a negative feed back stating them as a fraud. You are not out anything by having your bid rejected. But a fraud complaint doesn't sit well in one's feedback rating. Just keep it truthful.

The seller will take pay pal on the tractor. I wonder if we should go ahead and go through with pay pal to kind of have proof that we were not only the high bidder but paid for the item with in a few days. If we dont do anything they can say that we never paid. The only proof we have right now that they would not accept are bid is a email.

The seller has already demonstrated that he doesn't do what he says he'll do. I would NOT send him any money. Go find another tractor to buy.

I don't know if I would want to try and force someone to sell me something, or not. You could certainly add to your case by paying with Paypal. You should be able to get your money back through Paypal also. I've recovered payment on an item that the seller didn't ship to me, when I went back through Paypal. Forcing the sale to be honored through the courts could be costly both in terms of expences and the condition of the item that you wind up with. Good luck!

You can complain to the "powers-that-be" at Ebay and tell them that it was a "no-reserve" auction and it should be honored. They probably won't do much, but you can at least complain.

You won the auction and that final bid is a contract. You can take them to court and you should be able to win that. I say should (the legal system usually favors the bad guy).

It does say when you place the bid that it is a legal binding contract. Unless they had some notation in the auction about a reserve, right to end auction early or something, then it would be a binding contract in my eyes. If you have to stand up to your side of the bargain, so should the seller.

I had a similar experience a couple of weeks ago. I threw in a last-minute bid on an antique Fairbanks-Morse hit & miss engine and saw rig, and won the auction for the minimum bid, which was $500.

Shortly thereafter I got an e-mail from the seller (who had listed it for a friend) claiming the engine had been stolen and that he had been canceling bids but didn't get to mine in time. I responded and asked why he didn't just end the auction if the item was no longer for sale -- eBay allows you to do that. I also asked him to fax me a copy of the police report of the theft.

His story: He didn't know if a police report had been filed, as the engine's owner had been so upset by the theft that he had a heart attack and was in the hospital.

Sounded fishy to me, and I filed a complaint with eBay, but I don't expect much to happen with this. I just ran across a bad seller -- that's bound to happen from time to time.

Darn. Would've liked to have that engine, too.

Guess I got my T.S. card punched on that one.

There are PLENTY of tractors of ALL kinds out there that can be bought in the ole fashion "SAFE" way. It does require a little more effort than punching a keyboard though. Why in *ell would you buy a TRACTOR off E-BAY anyway??? Small items, maybe, but not tractors! There's only two reasons for someone to list a tractor on E-Bay. They either want way too much for it, or they are going to be dishonest about it in some way, and need to be isolated from the consequences for their actions. If you "play", you "pay"! The internet is nice,but the "SCUM" is thick because they can't be cought and if they are it's almost impossable to prove "intent".

Why would someone buy or sell a tractor on ebay? I sell rare and buy rare tractors on Ebay. I do understand your point though but trust me I have been in tractor dealings for 38 years.
