We switched L P gas suppliers….the new company pumped the old tank empty so we called the old company to come pick it up and send us the balance they owe us from the prepay plan. It’s been several weeks and two calls and the tank is still setting in the yard. Office gal says she can’t send the money they owe us because we still have the tank on our property.
On this board I’ve seen people say to charge rent for each day it sits in my yard…...Does this approach have any legal standing?? or will the supplier just laugh?

I had one set around in my way for about a month. I sent them a registered letter stating that they had until a certain date (about 15 days from the date on the letter) to pick it up or I would consider it abandoned and would convert it into a water tank. They picked it up a couple of days later.

You need documentary evidence of you position.
Put it in writing, send it recorded delivery - so they can not say they never received it, and keep a copy.
Be very careful how you word your letter so that it is absolutely clear, but not threatening any action which could be deemed illegal. That way you have a documented baseline to continue any further action as required.

I ran my Ferrell gas tank empty and painted on it DO NOT REFILL! They still insisted on refilling it but Mama wouldn't allow it. They showed up to fill it at 10:00 AM. I was working 12 hour overnight turns and was sleeping when she confronted the driver. I actually heard her say over the air conditioner no less that she really didn't want to wake her husband up to explain to him why that tank wasn't to be refilled. It only took them a month and a half to get the empty hauled out of here.

As far as charging for storage on tank, you can.

As far as getting your money back on prepay I don't know.

You hopefully don't have a lot of credit left.

You might end up trading credit for storage.

When they did that to me, I finally called and told them I was going to move their tank to a new storage area on my property. I had decided it was an eyesore in my front lawn, and that it was now going to be moved to the back of my 80 acre woods where I wouldn't have to look at it anymore. They should give me a call when the were coming to get it so I knew who was going to be driving through my woods to pick it up.
They came two hours later and picked it up.

I'm surprised the new company would touch the old tank. I don't think they are allowed to pump out one from another supplier.
