Ah, don't sweat it, billy. I was gonna get in on the thread and then decided not to. I've shot off my mouth enough on many subjects so decided to give this one a rest. ";^)
My brother had somebody give him a perfectly good running David Bradley walk behind. He didn't even know this guy but since his (my brother's) name just happens to be David Bradley, the guy thought he should have the machine. Dang thing starts on the first pull!!
Don't know of a Lester tractor do you?

If the guy new what he was selling and took it then its a done deal. The only scammer on here is billyiron because he is just crying because he did not get it. In fact I think I know the real story and location of this whole deal and the jockey that bought it sold it for salvage.

I guess if the old guy didn't have alzthimers it would have been a square deal? There's probably plenty old farmers/people that think if they paid $1500 20+ years ago, and now it has wear, then $500-1200 is a good price, not knowing that stuff even 10 years old is selling for more than purchase price. So where do all the once in a life time deals come from? Somebody got screwed, whether illness or not knowing the value of their stuff.

where did this take place? .... you say that the jockey offered him 750$ and he took it and your feeling is that he screwed him out of it. would the elderly man still be "screwed" if he was asking 750 for it and the jockey bought it or is he "screwed" just because the jockey offered it?? if these 730's are worth 10 times what the jockey paid for it, how many do you want to buy as i will sell you a couple for that. people are so quick to say what something is worth but are never willing to buy it.... why is that

Remember what you've read here guys! Anyone who would take advantage of the elderly are bottom feeders. And those who condone such actions, of which there seem to be a few here, are people to steer clear of. And I'll bet that they will cry the loudest if it were to happen to an elderly member of their family.

Seems like two thirds of the people that replied are guilty of bilking the elderly, thus defend someone who has taken advantage of another god fearing christian brother. shameful, go back to church boys.

By law the deal is void bacause the old fart did not have enough mental abilty to understand what he was doing and in ILL they would lock this guy up in a heart beat and make him return tractor check with local ststes attorney

I wonder what folks would say had the story line went:

There was this guy lookin' to buy a tractor and this old fart told him his 50 year old 730 was the rarest tractor in existence, porbably the last one known and he bought it new and only ran it on Sunday's. He sold the clunk to this guy for $20,000.

Yep..... the buyer was a stupid #$$ and deserved to be took if he didn't know any better. I'd lay odds that old man you mention probably figured that $750 was an honest offer, seeing as how he gave $1500 and ran it for 50 years.

okay...maybe it sold for ten thousand or sixty eight hundred or thirty four hundred or fifty five hundred or any other price. It's now 2005 AD. Been at least 46 years since they made a 730, so I doubt it's even close to new....you reckon? So the old man sold it for $750. I guess everybody would have a warm and fuzzy feeling had he been offered and accepted $3,000? Well, he wasn't and DIDN'T. He was offered $750 and took it. geezus, get over it.

Old dude,

My grand pap had alzheimers and finally croaked when he was 96...that was 4 years ago. He didn't know where or when he took his last dump....if he'd have asked we would have told him....right there in the bed. He couldn't have more sold a hubcab, let alone a tractor. And whether anybody belives it or not, none of use felt sorry for him or when he died. He lived his life and half of somebody else's and it was a relief to all concerned when he died.

As far as the man in the above illustration is concerned; if it was his tractor and he was/is in control of his affairs, it was his to sell/junk/burn/ or give away as he seen fit. he could have said no to the $750....regardless if he knew what it's worth was, or not. However, he didn't say no and accepted the cash as legal tender and closed the transaction. Regardless of what the amount of money was, there was a transaction.....cash offered for goods and both parties accepted the terms. Nothing illegal about it and if his family leaves him in control of his affairs, he can do as he pleases. What if he had GIVEN the tractor away?

Mark & B&D Comments are interesting to say the least. I knew a gentleman, who was never married. His place resembled a small John Deere museum. He had some siblings, all lived away. He had several 2 cylinders. Most he bought new. The only time they were wet or were away from their sheds was when he was at the wheel. Well his mind began to fail. He would drift in and out, not too bad, but he wasn't himself. He maintained his farm and equipment almost until the end. In his last years things began to disappear. 3 of his tractors sold for a "reasonable" price, to a fellow that did a B&D style restoration on them. They were resold later for enough to cover their parts, and their time, easily. The person who took the old mans money was a little smarter than the tractor jocks. He didn't have to restore the cash. By the time siblings arrived on the scene, not only was the horse out, but the barn was burned, and the land a strip mine. Boys & Girls, what goes around, comes around. If we all live long enough, we all may out live our minds. Some things may not be illegal, but they may be immoral.

I would like to get 1st hand info on the situation rather than 3rd and 4th hand. They’re maybe some “sour grapes” feelings from the source. And everyone love tell a story These stories are a dime a dozen and rate right up with the guy driving the back roads on his way to Florida. He sees and old Harley leaning against a shed and decides to ask if it's for sale. The old Harley changes hands for salvage parts price. The new owner finds some odd things during the restoration and runs the serial number. Turns out it's the last lost Custom Harley that Elvis had built. The story goes on to say the bike was purchased by Graceland for 1 Million plus..... ..... ..... .BS. Now if everything happened as per the story then the tractor jockey is a low life. And where was this poor old fellows family or friends?

The state and federal governments have passed laws protecting the elderly from these fraudulent transactions. One big reason is taxes. If the farmer sold his 730 JD for $750 and it was depreciated out from it's original price of $1500, he will have to pay a little capital gains tax. If he had sold it for current market value, maybe $7500, he would pay much more capital gain tax. The jockey that bilked an old man out of his tractor may get some IRS attention;they will want either gift tax or cap gains tax. Can he give it away? Not if it defrauds the gov't of taxes due.

Chances are, in a lot of states, this is nothing to worry about. With all the deductables and "Ag Use", and everything, it's doubtful it will hurt him. Even if he DOES pay the taxes, he will still make money.

That sort of scumball move is a REAL sore spot with a lot of DA's and Judges. I suggest you file a complaint with the Sheriff. Could be it's a FELONY in your parts and a citizens arrest isn't too far out of possibility.

Maybe not for you to do but someone in his family needs to turn this over to law enforcement. Maybe someone has power of attorney. If it was a good 730 worth ten times that and this "buyer" was a machinery person then fraud was committed. JMHO

I'm wondering the same thing and a few other ideas. If this poor fellow with failing health didn't have a Power of Attorney. Why is everyone in such a rush to lock the barn now that the horse is gone? I've seen all kinds of two cylinder diesels that "ran good" but..... ..... ..... By the time the gauges were replaced, the sheet metal straightened, new fenders, new battery box, new batteries, wiring, new grills, decals, entire three point hitch, four new tires, steering wheel, injection pumps, transfer pump, injectors, new guides and valves in the head, boring for new pistons, turning the crank and three new main bearings, a taper-loc flywheel, new clutch everything, replace the trans/pto seal and new pto clutch plates, new pto guard shield. Then a quality paint job. No $$$ for labour just a few bucks for utilities and tools. That 730 was awful expensive at $750.00. That tractor was probably promised to a Son or Grandson too but the old fellow forgot. I wonder how a 45+ year old tractor owned by someone with dementia could be so mint & pristine? This story rates up there with those people who had a machine in decent condition and was even rare. They parked it in the weeds by the road and said no to every potenial purchaser as the machine turned to rust while settling into the mud. There is a case for Power Of Attorney as well.

I was thinking along those line too. There are two sides to every story. My story on my 720 D after it was all done is that if someone would of gave me that tractor I'd still loose money on it. No one is feeling sorry for me paying fair market value for a tractor with so much hidden problems ! And I just chaulk it up to the price of an education !

Doesn't just happen with machinery - lots of lowlife out there taking advantage of the trusting (elderly or not). One of the lowest is window companies (Paces***** and others like them). They prey on little old widow ladies who are trusting them to not take advantage of them. Drive-by-Repairmen are another example of lowlife sludge (scum rises to the top). I've gotten some good deals from people around here on old machinery, but they are neighbors, and have known me all my life. Sometimes they just want it gone to be gone, other times, they know it will be put to good use, instead of rusting away in the fence row.

Let me give you another scenario...all true, no tale.

I knew two old people when I was much younger....at least 35 years ago. Both of these folks had old cars, one was a 1952 Ford that had always been garage kept, looked great. The other was a '56 Plymouth with a 331 hemi. Both of these cars disappeared and when I asked the old folks what happened to them, their reply was: I've gotten too old to drive and got rid of it..... .had I knwon you wanted it, I would have GAVE it to you. Both were well into their 70's/early 80's at the time. Now, had i been first in line and they had given the cars to me because I mentioned an interst, would I have been a slimeball who took something they no longer wanted? The woman with the Ford, her brother came and got it and sold it before nightfall. The old man gave his Plymouth to another young man who yanked the Hemi out thinking he had a dragster engine (not) and junked the rest. Neither of these people felt screwed...they wanted rid of the cars and that was all that mattered to them. I think most of the sour grapes come from them that didn't get the tractor/car/farm, etc. As for being condemned for my feeling towards my bedridden and totally demented grandfather...you never walked in my/our shoes or dealt with the shell of a human being that ceased to live, but just existed. He ate through a tube, breathed on a ventilator and $hit the bed 24/7. You call that a life? We're kinder to our pets when they get that way and have them shot or put to sleep. The self rigteous had Kervorkian jailed but readily pay a vet to euthanize their cat. That, is disgusting.

That is a little different then some joe off the street, whose MISSION it is, to take advantage of someone. I don't have any ill feelings tword what you did with your grandfather - he's way better off where he is at. By the way - been there TWICE. Before you start railing on someone, make sure you walk in THIER shoes.

Galen,

I never directed any of this at YOU. I just posted at the end of the thread. I rarely comment this much on any topic, wherever i visit and that's a lot of boards. But, it just strikes me that folks get all righteous....especially if they aren't the ones who found the specail deal...then they think the guy who did is an a$$hole. It's sad to get old....but it beats the alternative. Not everybody who is old is senile....even if folks think they are. Very many old people come to grips with their mortality, know they are going to croak in the near future and when they have an opportunity to dispose of stuff they will never use again, they do so....maybe for nothing or very little. get over it folks, it happens everyday..maybe you'll get lucky and be the recipient next time. If not, quit your harping about the guy who did. For the record, the only way i ever got anything was via a last will and testament.
