Not a good day yesterday. Got home from work and had a note on my mailbox. Said I had to move my tractor from the driveway...it's an eyesore.
Now...I live in a sub-divison and keep the tractors in a rented barn. I bring them over to work on them. Sometimes in the garage sometimes outside. Been so hot here I had it in the drive way.
There is a new part of the subdivison that has on old battle axe in it. She wants to start a homeowners asso. but most of the old timmers have resisted.
I moved the tractor...but to call it an eyesore ticked me off. In who's opnion? It does need a little paint...but it's clean, no leaks, new tires and wheels...an eyesore I think not.
Now, this is the tractor that when it floods bad here people come ask me to use it and the trailer to get thru the water to get their stuff out. It pulls the T-ball kids every Spring in their parade, it mows at my church, and the kids come over when I am working on it to talk and watch...they are not getting in trouble somewhere else.
As you can tell I am still ticked. I plan to write the mayor tonight. I will remind him we do use it to help people when the city sets on it's backside in a flood every so many years.
Anyway...now I have vented...have a great 4th.

Thanks to all...I had to vent. No, I am not special, I do not think because I use it around home I should get special treatment, I just want to be equal.
I checked the regulations over the weekend. There are only supposed to be cars, pickups and light trucks in the driveway. No trailers, boats etc:
One thing that was funny. It said other than a clothes line, there can only be yard things in the yard.
Hummm....now if I put up a clothes line and put dad's old long johns on it...naa, better cool it for awhile.

In NY a Farm Tractor is not a motor vehicle, doesn't need an inspection, and can be driven on public roads so long as it has a slow moving triangle on the back - no insurance or drivers license required. At least that is what I was told by NY dept of motor vehicles. I also asked the definition and was given a tractor engaged in agricultural activities.

If this is true I'll bet your village code talks about motor vehicles parked in your yard or on the street. I'll bet the no parking ordances are written specifing motor vehicles.

If true they probably cant do anything to you.
BUT BUT !!! if your village is like mine their changing the laws from what's prohibited to what's allowed. In that case they got you.

Do your homework and see what the law in your area says. If you put on a plow, turn over 2ft of land and plant a tomato plant or two you might be exempt from all their crap.

Look at the white elephant laws you might have some protections.

If your only mowing the lawn and pulling a wagon in paraides in NY you might need to register your tractor with SPEC-COM plates and go through all the notmal motor vehicle stuff.

good luck

Home owner's assasination? Oh no. Today I did this phone repair for these folks that are...very wealthy. Have 10 acres in rural Illinois, and a house that is so huge, looms over the neighbors $300K - $500K homes on two acres lots. Is huge, and has a telephone system inside. The husband is a big Africa game hunter - in the livingroom, has a giraff, hippo, lion, and other big stuff, stuffed. These folks have mega-bucks, including 3 or so fulltime landscapers that work on their yard only. Here's the funny thing. The nieghbors with the smaller houses and smaller yards, started a "home owners assasination", and since these folks got their property from the same developer, have to be part of the same assasination, and attend meetings too. So much for getting away from the rat race. That would be reason enough for me to sell the darn place. And since butts up to a man made ski lake, along with all of the neighbors, there happens to be a small island behind their property, and the folks directly across the lake from them, so the village gave half of it to them, and the other half to the other folks - so someone could pay property taxes on it. Guess I wish I had their problems, and their money.

Good luck.

And they say we have a free country...? People are more concerned about apprearances and being hi filutin, some areas around here you have to keep them in a garage or have gravel where the equipment sets. Stay free Gents.

Boy you just hit my hot button. Dad would park his equipment along our driveway when not in use. Dad died a few years back, and the farming equipment stayed where it was parked by Dad. Some one driving by didn't like looking at the farming equipment, and complained to the city. We received a notice from the city saying everything had to be removed. After about three days I was calm enough to talk the the young lady in the code inforcement dept, and explained this was a farm, and still is, she backed down. The equipement is still there, and I don't intend on moving it. Some times you need to stand your ground. Stan in calif.

County Council here is spending half their time worrying about "Eyesore Vehicles" They need to worry about "Earsore Vehicles"... the cars that ride the roads with no tags or insurance, playing that booming bass music. I bet most of them could be arrested for DUI, or drugs.

You don't say who left the note. If it's an anonymous note, ignore it. If it's from a private individual or homeowners' association, I'd still ignore it.

Now if the police or code enforcement left it, that's another matter. Have them show you the ordinance that you're supposedly violating. If they can't come up with a solid violation, then you can read them the riot act.

Be careful about who you pick a fight with and over what. The cops and code enforcement cops can make your life quite miserable should they decide to do so.

I agree. I also believe there is a time alotment for you to conform. Use the time alotment to the limit then just put a tarp over it till the next letter comes. Then move it for one day and start over again. If and when the person doing the reporting decides to show themselves, you'll know who to return the favor to. Neighborhood feuds are never a good thing, but sometimes they cannot be avoided.

US mailboxes are only for US mail. Next time there is unauthorized mail in or on it, turn it over to your local postmaster. Should a postman find these messages first he will tell the postmaster and you could lose home delivery.

And, any message is mail.

I have a noisy old bitty in my neighborhood to. She likes to take pictures. She leaves me alone now after 25 years but anyone new she tries to intimidate. She left me alone when I added to everything she complained about. You should do some arc welding after dark.

She will not rest in peace. The gophers will make to much noise.

That @#$%^ lives 3 houses away from me. I had my old backhoe in the driveway. She went to the code enforcement people. I kept it there for two months until I was finished working on it. Next I had the equipment trailer there. Moved it after a few weeks when she complained. To get even I turned in over a hundred complaints around town. That kept the code boys jumping. What I learned from this is they do selective enforcement. Her house has peeling paint. In 3 tries over 3 years they haven't made her fix it. It is a violation of city code. I just had the trailer and my Bobcat in the drive for a week. I'm sure she compalined again. I hope they came to see it as I've since moved it to my other house.
Fight them any way you can.
Next time they come around here I'm going to go after them for selective enforcement as many of my original compalaints have never been taken care of.

Yup - I learned about "Selective Enforcement" in the same village I had the other troubles in. Town cop was the nephew of the neighbor across the street. I would get a ticket for parking on "HER" side of the street, but they could park on mine and even facing the wrong way. Took photos and had the county sheriff out several times to verify. Had a fun time messing with them on that one! Got bunches of signatures and other people together - ended up getting the cop fired. Town TRIED to get back at me when I wanted a privacy fence - told me "NONE WERE ALLOWED IN THE CITY LIMITS". A month later a neighbor got a permit to put one up. I just planted a bunch of Privit Hedges along the property line and let them grow WILD. No ordinance to keep them trimmed. Had the mayor ASK if I still wanted a privacy fence - told him "NO - I like the way my hedges look". We had 3 dogs. Town passed an ordinace that said anything over 2, you had to pay a $200 "Kennel Fee" (wasn't passed because of me, but someone with 9 dogs, who was acually practicing for the Ididarod Race). I licenced 2 in the town and one "became" my sister's dog and was licenced in another town. He was "visiting" us for over a year. Sometimes you CAN fight city hall - just pick yer fights (and, above all, have fun doing it!).

Our county passed an ordinance about dogs and cats. They wanted to charge a registration fee for every dog and cat in the county {outside or indoor pet}. The fee was 25$ (I think that is right) a year per animal unless it was spayed or neutered, then it would only be a onetime fee of $5.

I have two dogs (one neutered and one not), and I just took their collars off. We live about 5 miles from the closest town (out in the sticks), and 11 miles from the city where the ordinance originated. So far as I am concerned, the two dogs (which originally moved to my house from the neighbor"s house) are strays! I just put food and water out for them (because I am so compassionate), and they sleep on our porch.

I know a county cop {another neighbor of mine) that did the same thing with his dogs! This county also came up with a junk vehicle law, where a person has to build a fence to hid vehicles that do not, or have not moved in a month. But that law is seldom enforced anymore!

Bill46, I think you can use the Freedom of Information Act to find out who complained about you, but if the city fuzz came to see you its between you and them. Different places have different rules so like someone said, check the law.
Here the county has a junk car ordinance and they are running around hauling off cars with no tags or insurance. The local news rag posts telephone numbers to call to report junk cars, encouraging neighbors to rat on neighbors. I don't think anything is said about farm equipment though. Don't know what local cities say. I've always said I would like to put a tag on a junky vehicle and park it next to one of the junk car Nazis. Come to think of it, some of the vehicles I run meet that description.

I thought about that. Go and find the uglist thing I could find, have it inspected and put tags on it and park it on the street. Something like an old pink school bus or an ex military vehicle painted yellow with lots of mud on it.
Being a retired military type I could really get into this....Ha!

Yup! The same town I had the grass problem with passed a "JUNK" car ordinance. I had a 1947 Chevy pickup in the BACK yard. It ran and drove - just parked it there, no tags. City hounded me about it. They wanted me to "move it or hide it". Got antique tags from a different county (one I had property in). They got upset about it, because the tags changed it from junk to legal. Still stayed parked there, but the tags "hid" it!

Better check and see what the laws say for your area.

My sister had a RV parked in the drive and others had boats and such.

One battle ax moved to the neighbor hood and called the law.

Seems they had some law on the books about eye sores and blocking the view down the road. Nothing is allowed in the drive or street that is not moved daily or over a certain size. Basically only cars and pickups were allowed in front of the house.

Well...I am going to have a visit with the city councilman and the mayor. I will act nice, and not mention the old battle axe.
As best I can recall...getting old, they have started a community club and wanted everyone to join. Most in the old section refused so now we are paying for it.
They could not have a true HOA, but if you refused to join their "club", you are on their bad list.
Just talked to my neighbor and he said he got one for having an ATV trailer in his side yard. That thing is tagged and legal. I just do not understand that.
I promise I will be good...for now anyway.
Thanks guys...have a great 4th.

Find out who wrote it, and send back a nice card that says she herself is an eyesore! Mind her own business till you get new zoning laws. JMHO, Had a lady that did not like farming in the neighbor hood, if we parked a tractor for the nite in the front yard, too close to the road,, like say 75 feet off the road, she would call everyone to do something! Usually the area plan comission,, or the police,, one day police, and the plan commission came out in one day! too kone look at us, and laughed,,, the plan commission inspector went down to her home, and wrote her a ticket for having an old truck sitting out back that wasnt drivable! I laughed for 3 days after that,,,,, Chad

Bill, the only one who even comes close to being right here is txgrn. Do not attack a neighbor on spec. Leave her out of it completely and attack your REAL problem....the zoning guy. But be careful how you go about it. Example:

This spring I decided to lower my mowable lawn from 2.5 acres to a somewhat lesser amount by no longer cutting a hill south of the house. A month ago a zoning guy came to the door and told my wife that "people were complaining" and that under the weed ordinance I had to mow my hill. The wife ( a sage veteran of zoning affairs) asked him what the ordinance number was. He said he had no idea but that while we were at it, we should put down some fertilizer and maybe prune the hedges a little more. She asked what the code number was on THAT. He didn't know. He said the wife had "issues" and that he would send a letter and it would be $500 per day fine until it was done. He refused to leave a card and left in a hurry. Let me mention that we have a beautiful home and maintain it.

We went down to the township and looked up the ordinance. We found wording that excluded us
and presented it to the guys boss. Turns out I did not have to cut that dangerous hill. The grass, which I intended to cut once in the heat of summer is long and lush and will stay that way.
You should do the same. I'll bet there is no law against working on that tractor in your drive as long as it moves from time to time. Your best revenge against the neighbor is to prove her wrong first and leave the tractor where it is.

I had a "Great Grass War" in a small town we own a house in. We had a neighbor girl mow the lawn for us. She made the mistake of mowing a strip about 10' wide outside of the fence. She did this TWICE. The fence is 1' inside our property line. The city owns the lot next door. We told the girl to only mow one swath on the outside of the fence, since the rest was city property. Lo-and-behold the city lets it get about 2 1/2' tall and sends me a nasty-gram to get it mowed - or else. They finally mowed it and sent me the bill - $300!
Went round-and-round over a piece of grass 8' x 100'. FINALLY, after showing them the corner stake 3 times and the city lawyer sending me another bill (for his services) for $210 - They realized they were wrong, but still wanted paid. Told them were to go with it and called the State Attorney General. Bills magically disappeared and had a hand delivered letter of appology signed by the Village People (council) AND the city crew (all 3 of them), and the city attorney.

Time to launch some counter moves on the old hag. There has to be some law or ordinance she is violating no matter how obscure. She's likely so unhappy with her life she has to make others miserable too. City Hall will appease her or you, which ever is easier. Make certain City Hall see's you as Mr. Modest Wonderful. And the hag as a hag, but yourself don't say anything negative about her in the process.

Your getting close to one of my worries...County is "all most" telling evry one to remove that pile of old machinery out back of the barn. It takes only one complainer. I don't know how many times I have used a piece of iron or a hose, or something to help me repair. Just a sign of the times when "rural house" means at least 400,000 with no old buildings or any thing that smells. Many times I think I have lived too long.

Eyesore or not, if there is not a specific ordinance prohibiting parking an operational tractor in your yard then tell the old fuddy duddy to go fly a kite.

I know municipalities sometimes will pass ordinances for abandoned automobiles in the street and others for them sitting in the yard, but your tractor is not an auto and not abandoned.

That's what's wrong with out society today: People thinking they have a right to impose THEIR WILL on others. For some reason they can't see the flip side of that record; just their side. Religion is a perfect case in point. To believe or not, if so what and in what, and how to manifest the belief, and how to act and all.

It's unfortunate that things are getting that way. I hate neighborhoods for that reason, among others. People should just not live that close, it causes problems. That aside, I firmly believe in property rights, and allowing a person to do what they want on their land. Yes, it would be less than perfect if your neighbor chose to make a lawn mower salvage yard out of his land..... but..... that's his right. If you don't like the scenery, put up a fance. That's the way I would have it.

If they won't let you keep your tractor in your driveway..... you NEED to fight it. Not by getting red faced and yelling, but by changing the law that bothers you. Too many people are letting their property rights slide down the tubes. -Phillip
