DURANGO, Colo. (Reuters) - A Colorado judge ordered two teen-age girls to pay about $900 for the distress a neighbor said they caused by giving her home-made cookies adorned with paper hearts.

The pair were ordered to pay $871.70 plus $39 in court costs after neighbor Wanita Renea Young, 49, filed a lawsuit complaining that the unsolicited cookies, left at her house after the girls knocked on her door, had triggered an anxiety attack that sent her to the hospital the next day.

Taylor Ostergaard, then 17, and Lindsey Jo Zellitte, 18, paid the judgment on Thursday after a small claims court ruling by La Plata County Court Judge Doug Walker, a court clerk said on Friday.

The girls baked cookies as a surprise for several of their rural Colorado neighbors on July 31 and dropped off small batches on their porches, accompanied by red or pink paper hearts and the message: "Have a great night."

The Denver Post newspaper reported on Friday that the girls had decided to stay home and bake the cookies rather than go to a dance where there might be cursing and drinking.

It reported that six neighbors wrote letters entered as evidence in the case thanking the girls for the cookies.

But Young said she was frightened because the two had knocked on her door at about 10:30 p.m. and run off after leaving the cookies.

She went to a hospital emergency room the next day, fearing that she had suffered a heart attack, court records said.

The judge awarded Young her medical costs, but did not award punitive damages. He said he did not think the girls had acted maliciously but that 10:30 was fairly late at night for them to be out.

I've been around the sun 66 times. Each trip around it seems our society, in my case the USA, seems to become sicker and sicker. Thank God we can look forward to a better life in the beyond.
I pray the girls will not stop doing kind deeds.

Looks like we all have to work to get something in place where there is a way to remove these moron Judges from the bench, too many lawyers, no common sense, I think the way things are now that if Ben Franklin had what we now have in his day that he would have been thrown in jail for flying a kite without a license.....

Thanks Butcher for the Denver posting. I was wondering what happened to those poor girls. Could not believe what I read in todays Los Angels Times. I still can't believe that there was a judgement against them. Times have sure changed from when I was a kid that age,(and they were leaving cookies) running around at night and we weren't leaving cookies.

Learned my lesson, I've always had equipment, backhoe, tractors & trucks. One year after a particularly heavy snow fall,I plowed out several of the neighbors. at one house is an elderly couple so while I was at it I made a couple of passes down their drive as well. The next morning "she" slipped on her sidewalk next to the drive, fell and broke her shoulder. A few weeks later she asked my wife to tell me to never plow their driveway again. Seems it was my fault in her mind that she had her accident. Incidently I also shoveled the sidewalk while I was there, but it iced up overnight. Luckly I did not get sued and we are still on friendly terms, but I clear my own driveway then put the toys away. Several people a year don't know enough to slow down on our twisty, poorly maintained back road and end up in the swamp or on their side in one of the ditches. Each time even though I have all the equipment, I call 911 and get them professional help. (and on 2 occasions a DWI ticket) I just won't take a chance on the liability anymore.

I guess you need somebodys medical record before you do a good deed because the normal responce from the mases would be to not to have an anxiety attack. A person probably would throw the cookies away by how they were delivered.

Lots of posts attacking the woman...but...if you knock on my door after dark, and then run away... well, I might not be too happy about it myself. If the woman lived alone, and got scared, she could easily have an anxiety attack. The girls meant well, but the woman never asked for cookies, and only knew somebody rang the bell and ran away. Personnally, I would cut the woman a little slack. Just my humble opinion.....Stan

Stan, On what legal grounds would you find judgement for the 49 yr old woman? What law did the girls break or even attempt to break? Additionally, on what moral ground could you find for the woman?

Sorry Guys - This sounds more like a factious story, the news paper has a hole to fill so this and a lot of other short, un provable stores fill these holes, ie man in far away county goes to the outhouse throws a cigarette down the hole and kapow blows himself out of the backhouse.(depending on space) Mr..... is in hospital with third degree burns. Family plans to sue the contractor who was supose to empty it in November..... for 5.3 million..... His wife is worried they won't be able to have any more babies because most of the burns are in that area..... . and she is worried Mr..... won't be able to go to the nudist camp they had planned for on their summer holiday..... .

I still can't believe it.

I guess there is truth in stupidity.
Just can't imagine anyone suing over a plate of cookies, even if she misunderstood the deed. What about the real pranksters, vandals they can be scary, paper bag of doggie doo on fire, rotten eggs, car keying don't hear about court dates for these deeds, but then again they don't fess up either.

Some dummy teenage boy tried something similar to a neighbor when I lived in TX. He got a 12ga blast in the back of the head. The law in TX, at least at that time was, you can kill trespassers on sight, no warning, no nothing, and it was all perfectly legal.

What difference does it make whether they were delivering cookies, asking to use the phone because they had run out of gas (I forgot, they both probably had cell phones), or just wanted to visit? What law did they break? Why do we need legislatures, as long as we have law-writing judges? I realize this is "civil" rather than "criminal", but where is the precedent? If they had just kicked the door in, broken her arm and robbed her, they would have recived probation..... .....

Although I agree with buikanddeere completly, I will add that the media is somewhat to blame here as well. all you ever see or read about anymore is the coruption of society, so Young may very well have felt she was being singled out for a prank. She very well may not have slept at all that night and fatigue could have helped bring on the anxiety attack. I wish more people were kind and generous like the two girls were. But..... ..since that's not going to happen, get used to reading stories like this.

It may not be so much that the media is to blame, but they are certainly willing accomplices. The real culprits here are judges and trial lawyers who have too much time on their hands. Perhaps its time for society to start bringing frivolous lawsuits against lawyers and let them see what its like to be on the other end. The only thing wrong wth that thinking tho is that it would further clog up the courts, which is a bottleneck of justice as it is. People who have legitimate issues to be heard are either stuck on the 4th page of the docket, or given the brushoff once their case is due to be heard. These are the real victims of the vrivolous lawsuits which choke the legal system today, and those entrusted with our legal system are the culprits.

I think the key words in this post are..... .....

While knocking on someone’s door at 10PM is late; I think if it were to cause her any problems those problems would be that night. Not the next day after she has had time to sleep and relax.

If I were this neighbor I would be worried about the retaliation from the other neighbors because I brought on this suit. Not fun being the neighbor that no one will talk to or help.

The main thing some neighbors do not think about when taking action that does not agree with the neighborhood as a whole. You still got to live here with these same neighbors after you pi$$ them all off.

Yes its true GCHAS or Gift Cookie Heart Attack Syndrome has become more prevalent in recent years.They should have been sent up to the state prison.

All ways two sides. She did have to go to the hospital and the judge only allowed for her hospital bill. While at first, this sounds rediculas...I personally have had to call a friend to take me to the hospital for the same reason. Believe me! it is not plesent to have your heart doing strange beats late at night. 871 dollars is cheap for a vist to the IR. Mine was more like 3000. Just one of those things...if only they had knocked on her door during daylight...

If only the whole world could predetermine the consequences of such frivolty. Had the girls knocked on the door during the day, it might be said that since the sunlight blinded the woman to where she couldnt tell if the sillouettes approaching her door were teenage girls or muggers, it caused her a panic attack. Sorry, but the whole thing doesnt wash with me. If these teens can be punished for their deed, then God help us all if we ever expect another one. No wonder the world is going nuts.

Its head cases like her that have raised insurance premiums, workman's comp claims, political correctness and infested our lands with meddling lawyers.
