This past Sep I agreed to purchase a JD 3Pt hitch from Floyd Smith, Anniston, AL. He cashed the check, but I have never seen the 3Pt. Has anybody had this problem and if you have, what action did you take. I have turned mine over to my legal advisor.

Was told by a lawyer I once hired that when the local cops tell you to file a small claims its a civil matter they just dont want to mess with it but theft is theft. I've got the same results from Attorney Generals and Postal Inspectors.

Contact was mdes using several E-Mails and then the phone. After the forth phone call and leaving a message, He answered today but hung up as soon as he found out it was me.

On the other side of the coin, I purchased a wide front for a John Deere many years ago by phone, from Surplus Tractor Parts (North Dakota, I think). A guy from a nearby town was going back east to pick up a tractor, and I made a deal with him to pick up my axle as well. Went over to his place about a month later, and he had skipped town (I never saw him again)- and I assumed he had skipped with my axle. About 2 years later, Surplus called and asked when I was going to pick up my axle! I had sold the tractor in the meantime, and they refunded my money without argument when I broached the subject with them. Nice folks.

i had a similar problem with justin miller in blue earth. noone really wanted to help. i filed a complaint with the postal inpector via thier websight.they said the amount 60.00 wasnt enough to warrant prosecution but if enough people file similar complaints it would show a pattern and they may go after him... you could go to the court where he lives and file a criminal complaint or a small claims case.i dont know if you could do that via u.s. mail .usually you have to show up. the best way to buy from someone you dont know is to use your credit card at paypal. at least then your card co. could file a chargeback on your behalf and get the money back.you have a big chance of getting ripped off on ebay to if the seller dont accept paypal.. lucas

The route with the most bite seems to be mail fraud (it put Capone away). If you mailed him the check go talk to your local postmaster to get the ball rolling. Call the county Sheriff where he lives too. Nothing seems to wake a fellow up as much as a black and white in the driveway. Most Sheriff calls will invoke a visit in rural areas on a slow day. Call him. If you worked over the internet and the amount was over $1,000 He may be looking at jail time for internet fraud and interstate theft. Send a copy of all reciepts and corespondance to his states Attournies General. You may just have to send him an E-mail listing everything at your disposal. Sometimes that is enough along with your post here to wake up someone sitting on your finances.... It seems to have worked for me. I am prepared with all the above as well as a cousin Governor, a nephew in the DCI and many friendly politicians (election year you know) to hang a fellow I have had issues with. If you are angry don't bluff tell him what you are about to do wait for some reply (not too long) then do it.

Capone was an IRS victim. Had all this stuff, and couldn"t explain to IRS how he"d acquired it with no income. Was too smart for them otherwise.

Webster defines "victim" as one harmed by, or made to suffer from, an act, circumstance, agency, or condition.

That's what the IRS did to him....put him in prison. That act by that agency had to amount to some sort of inconvenience at least, for him. Course there are prisons for you and me, and prisons for the have-it-alls.

Didn't say he wasn't a criminal of the highest order.
