Hi All,

I'm a pretty easy going guy, to my mind.

One the 30th of June, the wife and I traded in a 2001 Windstar with only 15K miles on it for this 2004 Mercury Monterey. The only reason we traded was because the warranty had run out on the 2001; the Windstar never gave us a problem, ever.

The new one is a beautiful car; well,until we were handed the keys, that is....

Out of the past 6 weeks, we have had the car in our possession for a total of 4 days, now.

The rest of the time it has been in the shop for a long multitude of differing problems, the last of which is that of the left sliding door which wants to remain "full open" all of the time.

Got the car out of the shop on Friday afternoon at 5pm, with the door supposedly repaired;

Saturday took a trip and ended up driving home 60 miles at 30 mph with this goofy side door standing wide open.

I called the dealer this morning and told him I would like to involk the "Lemon Law".

He agreed with me and said he's never had to do this before, so he'd have to see what all was involved.

Wonder how this saga is gonna go down..... .

Nice dealer in that he agrees with you that this vehicle is a lemmon and should be replaced.

Hi Nolan,

I told him yesterday that maybe we ought to run this thing thru the Denver Auto Auction to be rid of it.

He said that no, that would just mean that someone else would then end up owning the problem. His exact words were, "It needs to go back to Ford".

People drive for 100s of miles to deal with him because he is just a straight ahead honest guy.

Hi Leland,

Naw, I don't wanna go there.

This isn't a big life threating problem and I'm just not going to let it ruin my day.

I deal with these people on a weekly basis, the guy is as honest as they come and besides, he has already told me he will get me another car.

I just don't think that being "lawyer-happy" & running to the white shirts is gonna help any of us that are involved with this headache.

If the Lemon law is nothing more than a series of long drawn out hurdles, I'll just trade the darned thing. I'm not going to get into a yelling match over a silly car.

If push actually comes right up against shove, I'll go out in the darned garage and fix the silly thing myself. It is just a piece of iron.

But it's not the guy you deal with weekly that got away with screwing you . It's FORD that laughing all the way to the bank. In ILL our attornry general has to deal with about 25000 lemon law claims a year ,it's not the dealer you have to fight its Ford and there white shirts it's really out of your dealers hands now you have to fight Ford .Already had the same fight you are getting into with GM over my new p-up new but had water stains behind speedo cover. come to find out flood damaged on another dealers lot. got a new truck but was a lost cause until state got involved then smooth sailing.

Update:

No, I'm not gonna throw rocks at anyone including FMC or this dealer 'cause he is one of the most honest men I've ever met.

This car is one class little outfit, full leather, full power and the whole "in living color" schmeal; but it is just a problematic unit.

The thing set on the showroom for roughly 6 months prior to our buying it, which is neither here nor there, but the day we were even considering it, they had trouble getting the doors to lock/unlock. Had to first order, then cut new keys and also replace & re-program all the fobs. Okay, now all is well and it sure is a nice car.

Then after writing the darned check, we are driving home from the dealer's lot and the thing starts shaking the wife out of the seat & the rear tires were making a "wop, wop wop" sound--understand, this is a brand new car with 0 miles & it's crossing the line branishing a $34K entry fee.

Back to the shop to get the tires balanced and rotated. No fix; bad as ever, if not worse.

While all this is going on, the car is pulling like a banshe towards the ditch; let go of the wheel and it makes a nose dive to the fence. Ford readily agreed to replace 3 square tires and this cured these two little problems.

The very next day (about the 1st of July), the sliding door problem started and the car has been in the shop ever since until this past Thursday.

The parts man told me that they have replaced every single part in the door including all of the electronic modules. They have reams of work orders and hours of hot line conversations with Ford.

We get it home Thursday night last and the sliding door is setting 1/2" deeper in towards the body than the drivers door and the rear quarter panel. It is adjusted wrong.

Friday morning I take it back in to have the body lines and the door adjusted. Get it home Friday night and it operates good and the thing looks right. Okay, we are finally good to go..... .Wait. Hold on there; not so fast Bub.

Late Saturday, here we go again. The left sliding door opens and then will not stay in any position except wide open.

This just had to happen when I'm over in the next county, so I drive 60 miles at 30 mph to get the little sweetheart home. Ever drove a mini van at highway speed with the sliding door standing wide open? Now, that's a trip.

So, afer 6 weeks of this constant wrangling with this pretty little car that we really didn't need, enough is enough. Even tho the car doesn't have 700 miles on it yet (most of that comes from the shop's continual road testing).

Talked to the owner of the dealership at noon today and he agrees with me. He says it needs to go back to Ford. I. E. It's a lemon.

I told him I don't want us ending up in a screaming match over this, so either way (whichever is less painfull for the both of us--either lemon law or outright trade) for him to get a 2005 loaded on a transport and get it headed this way.

I called the county courthouse & they told me that all the fees that I've paid to put the little darlin' on the road will be transfered & credited to the next car.

Now, the wife has always wanted to go the South China Sea route too and I'll be the first to admit that she is far and away light years smarter than I, but I just can't do it.

Too many years of listening to the older guys talking with my dad about what when on over there in the south Pacific a number of years ago.

Bad attitude, I know, but I'll stick with North America's stuff. I think I'm old and I admit that I'm really cranky.

And, if I see my old 2001 running around town while running like a well-oiled top, about one more darned time, I'm gonna loose it!!

Sorry for the rant, tractors don't seem to do this to me (quite so bad). :>)

You say tractors don't make you this mad ? That's more than likely because you don't have any 2004 models. These new tractors have all the electronics and plastic junk of todays cars. Also not so sure how much of that Ford is made in America ? Everyone is buying componants from all over and not telling where and they use the phrase North America Content , but don't forget North America also includes Canada, and Mexico plus some other places like Panama -Do they make anything ? they might ?

Hi Mike,

Heck, I don't know. The little sticker on the windshield says it was built across the northern border; so I suppose you're right. :>)

I've got an old Chevy half ton that I know darned well has over half a million miles on it and I could jump in it tomorrow and drive it to Pananma and back with no trouble.

Maybe we should have stayed on horse back?

I've been lucky and haven't had a lemon. Met a guy a couple/fews years back bought a new red Dakota. It was a sharp looking little truck, and didn't give it another thought. Then one day saw it setting out all dirty from obvious setting. So I asked, and he said is/was a lemon and was proceding through the court system. As I recall, he had to jump through hoops and the factory of course dragged the procedings every way possible. Finally, he bought a new truck and quit making payments on his red lemon. Guess who lost that one? About a year later the finance company or Detroit had someone come tow it off, and the guy's credit (at least) got hosed. He lost every way around. I don't know anything about the lemon law (other than heard of it), but don't get so PO'd that you quit making payments and lose twice, I guess - perhaps easier said than done.

Sorry to hear about your new car.
Here is your lemon law and how it should play out.

As far as the tractor coming inside.....
You were the first to post pictures of that white rain last year. Every one has been having a colder than normal summer. And it is mid August already. So what do you have..... 3 or 4 weeks and the tractor will be inside. HE HE HE!!!!!

You don't list what the failure modes/root causes for all of the service visits, but if the lemon law does not apply to you, I would trade in this puppy ASAP for a Honda Odyssey. I have a 2000 Honda ES Odyssey and the power sliding doors continue to work properly after 5 years.

Sounds kind of like my last new truck. Told the guy at the body shop I wanted 'joint custody' or at least 'visitation'. Wasnt mechanical for me though, 2' wider and 6' longer makes a huge difference in gates and such.

It sounds like all mfg. are having troubles with these power side doors. I know of a few people with GM that do this too.
