I went to pick up some items we purchased at an industrial auction today. I was standing by a table, talking to the auctioneer(well out of the way of everything).. Next thing I knew I was hit & thrown by a forklift, then I landed & he drug me along the floor. Only reason he stopped was he heard people yelling. He later said it was not his fault, he could not see with the load he had. I am so sore & skinned up, I can barely move, but I consider myself fortunate to be alive. The lesson here is to be careful, at events where lots of people are operating machinery, you never know how skilled or careful they may be.

Hey Davis, wasn't it you that was at an auction awhile back when the guy started the track loader in gear and it ran into a truck? I'm up here in NC so I probably know about many of the auctions you attend. Hearing about all the things happening because of idiots attempting to operate machinery when they don't know what the he-- their doing makes me glad that I'm not attending any of them. You may be a nice guy and not want to take these folks to court, and that's a commendable position. Thetre is way to much frivilous litigation going on nowdays anyway. I don't know exactly what you would need to do, but I would think you should file at least some kind of a claim with their insurance company. You don't need to ask for mountains of money, mainly you just need to legally document what happened. Having been dragged like that and being just generally beat up it's just a good way to cover your own a-- in case something shows up several days from now that is attributed to this incident. Just like any other accident it may take several days for something to show up that you wouldn't even think about having happened til you started hurting. If you haven't filed anything before then it puts more of the burden of proof as to the cause of the injuries on you. Just a thought and my .02..... ..

Wayne, I remember the post about the loader hitting the truck. It was in SC, but someone else posted it. I do plan to make contact with the Co. the driver works for on Monday, just in case I do have some injuries that show up later. I am not the kind to take advantage of a situation, but I just want to make sure I am covered if I have any medical bills. Most auction companies now require any riggers to have at least a million of liability insurance. This auction company does not enforce it, but I think they will after this happened. Regards, Davis

You were lucky to get away alive. They tell you to stay back a distance of 1 & half times the height of a machine. I worry about excavators at auction. People are swinging them around & only watching the boom; the cab tailswing could crush someone against the next machine. Kids or any amateur could be at the controls.

Funny thing was, I was nowhere near the areas forklifts the moving things. Normally, I would have been alert to the dangers. This Idiot was just going along with no idea where he was going.... I plan to make a few calls Monday, this idiot has no business trying operate machinery.

Guy is luck your a nice guy. Anyone not using reasonable care while operating machinery is ripe to endup in court. I'd hate to run over a stanger and think I'd get away with it.

there is no excuse for not seeing where you are going with a forklift. osha states to back with a load if your view is blocked.
