Thanks to all of you for your advise.
1. The backhoe was bought from a corporation and it is possible that it wasn't even on an inventory anywhere. I have left the money to cover the check in my checking, but it sure has been tempting. If nothing else I will simply move it to a savings and collect a little interest on it. I can't contact them because they are gone.

2. The H money won't make me or break me, but it needs to come to closure. My problem is that I can't get the guy to accept a certified letter, so it would be hard to get a refund to him. I am thinking that some storage fee is in order here, so I will go with that idea in mind.

I agree with Allan. The deposit is a show of good
faith that you will complete the transaction. He
is avoiding your letters,because he does NOT want
to come up with the balance owed.

I would just stop payment on the check at your bank. If it ever gets deposited and don't go through there will call you. Its lost you have tried to make it right thats all you can do. Iwould sell it if he ever call about it, charge him storeage and give him whats left if any. You have tried to do the right thing. Good luck wolfe

Jed,

I'm thinking that the whole of the deposit would be yours, because that is what deposts are for in the first place.

Sounds to me like the backhoe money is yours as well. You must just be livin' right! :>)
