A week ago a drunken 22 year-old driver ran a stop sign, crossed a county highway, entered my driveway and then slid sidewards about 150 feet striking a garage door, proceeding through the garage, exiting through the back wall of the garage, crossing a lawn and crashing through the door and wall of a tractor shed. He came to rest inside the shed. Other than a scalp cut he was uninjured and his drunken 22 year-old buddy was also uninjured. Both walked away. No one was home at the time of the crash but I was at a neighbor's home directly behind mine, heard the crash and raced home to see what had happened. The driver was operating on a license suspended only three weeks earlier for a previous operating-while-intoxicated conviction. He also had no insurance.

My reason for sharing all this with you is to give you a heads up on insurance coverage. Of course it varies from state to state and policy to policy but in my case with a farm/ranch policy from American Family, I am not covered for any farm buildings or equipment losses unless they are specifically listed in the policy. My two tractors, a '46 2N and a Jubilee usually live in the shed that was heavily damaged but I had left them both out back because they've been getting a little extra use lately. Both were acquired after the insurance policy was written and neither was listed in the policy. Needless to say, if they had been in the shed they would have been destroyed and I would be out their value. As it is, a wagon running gear that I was getting ready to paint was in the garage, was totalled, and is not being covered by my insurance company. Overall, my insurance company has been very responsive in settling my claim and there was no injury to my family, so I'm feeling ok about all of this but...

Don't drive drunk, don't let your kids drive drunk, don't tolerate others driving drunk and read your insurance policies. Like me, you may not be as well covered as you think you are.

Thanks for passing that along. Glad no one was hurt. I never thought about the tractors not being covered. Here in NH we are not required to have auto insurance, kind of scary.

I just switched agents, the one I had was a total moron. Anyway my new agent went over everthing, I have State Farm, he said State Farm doesnt cover farms, maybe they should look for another name. He said my house and garage was covered and none of my barns, equipment, or animals. He told me to get a different homeowners policy. It isnt cost effective to cover individual animals but if you have farm type animals and it gets out in the road and causes an accident your responsible. If you have horses and small acerage they will cover you because horses are pleasure. But I dont know about a tractor and mower.

Colin, Glad to hear no one was seriously injured and your tractors were not "home" at the time. Too bad we even need insurance. It's only because folks can be so irresponsible and unwilling to make restitution for their faults (so much for eye for an eye). I would seek a settlement in small claims court if this jerk's not willing to settle up out of court for uninsured damages. Best -O- luck!

Absolutely incredible. I certainly hope the police report was well written so the defense lawyer can't pick it apart. If it was one of mine I'd be sure to mention the fact that children (judging by the toys) could have been killed / injured had they'd been in that area at the time. Addressing your concerns to the prosecutor may ensure this guy is locked up before he kills someone. Obviously, this moron couldn't afford the SR-22 for insurance and chose to drive anyway which means he doesn't care about the laws nor does he have a "pot to ?iss in" leaving you to foot the bill for the uncovered repairs. I hope all goes well for you and you're able to repair your property without a large out of pocket expense.

I talked to my agent some years back about this because I have a lot of money in my shop. I also asked him about my tractors and he told me as long as they were used for the upkeep of my property, they were covered. Of course every policy will be different. I would work with the distric atty and be sure this guy gets locked up for this. Maybe the judge will order him to pay restitution to you. Doesn't mean you will get it, but will put more pressure on the drunk. Bottom line is thankfully your family wasn't hurt---- Michael Az

DID YOU HAVE ANY "FARM EQUIPMENT" GET DAMAGED?

The only damage to "farm equipment" was the loss of the wagon running gear. Since the adjuster is being pretty reasonable overall, I'm not going to get into an argument with him over it. I will however, be communicating with the driver directly about being being compensated for any of the loss that isn't covered by my insurance.

He should also have to repay the insurance company. That is why our rates are so high.

Those kids must have thought they were playing a video game. Too bad they weren't.

How fast was this bozo going? I have no tolerance for drunk drivers, and this bubble brain should be locked up for a long time. (I use bozo and bubble brain because this is a family forum. Please insert any other word that comes to your mind) Too bad though, he will probably get off with a slap on the wrist and do it again until he kills someone.

I have had these same coversations with insurance agents over the last 10 years in Ohio and Pa. Generally speaking, any thing that has wheels and a motor would not be covered under a homeowners policy unless it is placed on a rider. The one exception would be a lawn mower. The Oliver 77 had to be put on a rider before I brought it home to assure coverage. In addition the Farmall Cub that we have for lawn maintenance was border line because it is a "tractor" not a lawn mower. By the way ATV's and dirt bikes are not covered either.

Rich
