If someone before you had bought the tractor and has a signed contract, he may be able to execute the contract and you will lose the tractor. If they just had an oral contract, that is harder to prove.

If someone pulled that on me, I know I would go after it if I really wanted the tractor. First buyer should have also made a token down payment, I would have.

It is more the fault of the seller to sell it to two persons, but you are involved now!

Only problem with the buyer is that when he made a "token" down payment he asked that the check not be cashed. So he left a check, I don"t think that the amount matters in this case, and asked for them not to cash it. It wasn"t half the tractors price.

It was just weird.
