I got an email from Ebay yesterday stating that Deere and Co. contacted them and said my ebay user name (john-deere) was infringeing on John Deere Patent rights and that I have 7 days to change it or it will be changed for me. I am not real firmilar with how this law works, but I am not using a patented logo, I am not using John Deere patented letter style, I am not using it to make a living with, what if my name happened to be John Deere, Would I not be able to sign my own name? I am putting the body of the whole email so you can make your own decisions. Dear john-deere ([email protected]),

show me where I sold one tractor or tractor part on ebay! it hasn't happened. I have sold a few toys and a couple of pieces of literature, it is mostly for buying. as for this being a business, you would hear alot more from me if I was making a living. All I do is enough to help our collection. We are collectors first!

I just have to say that they should be looking at these asian countries that can do some REAL damage, rather than pick on us Pee Ons that wouldn't make an extra dime on the back of JD. I saw a load of cheap junk chineese battery terminal brushes at a flea market, Guess whos trademark they had Plagerized, Snap On! This country will ultimately be weakened by all the crap we import from china. The stuff is trash.

I agree with the majority here, just change the name on e-bay. Its not worth loosing sleep over. Any big company would do the same thing if so inclined.

I have done some checking, and this is what I have found. wal-mart, gm, chevrolet, coca-cola, mustang, kmart, are all regestered Ebay users, I could go on and on.

Just change it and save yourself a LOT of trouble. Someone up here had Snoopy painted on the room of his barn, and they came along and made it paint it over.

Dwayne,

Patents come and go over 17 years, copyrights can last 95 to 120 years - but trademarks can live forever. That's what they're protecting.

If I can find it, so could any intellectual property lawyer -- you've engaged in over 140 transactions in interstate commerce since '98 using that name. Makes no difference that you're not selling tractors -- JD has their mark on hats, boots, key chains, and even damn Christmas tree lights. Next thing some Chinese outfit starts selling green and yellow tractors with a cloven hoof running ungulate as a logo. Pretty soon there'll be an action claiming that JD has become generic and/or the mark has been abandoned.

It's not a big head that motivates them, and although they probably sound really arrogant to you; they're doing what they should have done some years ago. If JD doesn't police its mark, they could lose it -- just as FIT said about aspirin -- cellophane, thermos and shredded wheat, and even the Brooklyn Dodgers trademark have been ruled generic or abandoned by the courts. I don't think any of us would want to have Chinese tractors around that are green and yellow and bear the name of a guy born in Rutland Vermont. But that's what JD could be in for if they don't patch even the smallest crack in their wall.

If your name were John Deere, no problem; as long as you didn't use it to engage in interstate or even intrastate commerce. But since it's not, and you have - I agree with the other guys that's it's the better part of valor to retreat in the this battle. Cheap patent lawyers will cost you 200 bucks an hour. Good ones will go for 500 to 800. Federal courts move slowly, and JD has a lot more resources than any of us put together on this board. Doubt the ebay name is worth that much.

I know these kinds of things can get your blood up, and make you want to go on a kind of crusade; I've been there and done that for 8 years worth of patent fight myself. But step back for a moment and count off what you might win versus what it might cost you. Probably better to go back to JDnut or JDfan or something like that. Sorry you're going to lose all those brownie points on ebay.

Steve

Steve, thanks for your response, and believe me I had no ideas of fighting this. you gave me most of the info that I wanted and already knew, I just needed to blow off a little steem. Now I understand the diffrence between patent and trademark, This is where I was confused is that I didn't think you could patent proper names. but you can trademark them. thanks, Dwayne

Dwayne,

You're welcome. I guess a better and more to the point example would be Coca-Cola. Arguably the most valuable registered trademark in the world, Coke has never patented the secret formula for the syrup; because to do so would require disclosure of the ingredients, and only protect them for 17 years in any event.

Ferguson probably had more tractor patents than anyone in his time, yet JD probably makes more annual revenue from licensing fees from their mark on hats, t-shirts, etc. than old Harry Ferguson ever did from selling tractors.

If you want to be double careful for the next ebay name, you can search registerd marks free of charge as the US Patent and Trademark Office web site -- link below. You'll find that JD has 47 permutations of the name and mark design registered. Which is paltry compared to the 103 versions of Martha Stewart. Both proper names. My favorite JD mark - the 50's vintage 4 legged dear with the words "quality farm equipment" underneath is apparently dead / abandoned -- so it seems you could call yourself Quality_Farm_Equipment on ebay and get no argument from JD. Don't take that as valid legal advice, though. Even the high priced patent/trademark lawyers will give you advice which will cost you a lot of money to find out was wrong.

take care...

Steve

Dwayne, That's, in a way, hard to believe isn't it? But Ralph is correct, Deere has a world wide recognized trademark and therefore they must protect it , it's either defend it or lose it (that happened to Xerox and several others back in the 50's and 60's). You could even have problems if your legal name was John Deere. We had a guy here locally several years ago named Charlie Brown that lost a federal case over the commercial (I know you were not using yours commercially) use of his own name because famous trademarks at some point attain a secondary identify. In any event, it costs a fortune to win these federal cases and even more if you lose. I am not lawyer but due to the business I'm in I have been in numerous trademark and copyright cases over the years as a plaintiff and as a defendant. So, I got educated at the school of hard knocks and it probably would have been cheaper if I had went to Harvard! Anyway, in a nutshell that's pretty much the law and that's why they do what they do but it still doesn't seem right does it?

So the name you picked to use on ebay just happens to be the name of a well known company. Deere doesn't have a big head. You would have recieved the same notice if you had chosen "IH-Case", "Chevrolet", "Vermeer", "Martha-Stewart", or any other name that would imply to slow thinkers that you posess a reprensentaion of that company or person. Now if your Ebay name was "deere-fan", "jdnut", or a name that suggests that you like a certain brand, then you might not have recieved the email notice from Ebay.

Once I had to attend an trademark/copyright class held by my company, and they used an example of a company losing an important tradename because they let it fall into the public domain. AG Bayer, the german chemical/medicine company had a name for their particular type of Acetyl Salicylic Acid, which they sold in dry tablet form. By not enforcing their rights against encroachers, they lost their exclusive right to the name ASPIRIN, and it became public domain in the American lexicon.

That's why companies are so protective. They want and need to keep tradenames like KLEENEX, COCA-COLA, etc. their property.

Deere & Co. has to protect a tradename they have marketed under for over one hundred and fifty years.

Just my humble opinion.

Send them a DEERE JOHN letter! I suppose you will have to relinquish your use of their name; however you might enjoy telling them to get the whole name on their industrial equipment before someone else begins to use the JOHN DEERE name on a cheap line of equipment.

This is a comment that one of the deere corporate heads told me that if it looks like a cow and sounds like a cow, it probablly is a cow. basicly what that ment to me is that anything remotly close to looking like a John Deere would be illegal and they would take legal action aginst whoever created it.

I think if you check the legal code, you will find that they must defend any encroachments, real or implied, or they can not defend against any. I never fancied myself as being good at lawyering, but could usually figure out when I needed help. In you case I would retreat without consulting an attorney.
