Howdy Everyone,

This is going to be a long one so I suggest you get yourself a cup of coffee :-)

As most of the regulars in here know I have been having a dispute with the Village I live in over my display of horse drawn farm equipment. (Please do a search for "ordinance" for the complete story.) Well, it has come to a head and I would like to update everyone on everything to this point.

This past April I submitted a letter to the Village lawyer to get some clarification on some ordinances sence I am planning on building a new house. My last question to him was for clarification on junked vehicles on private property sense this is what the village was trying to use to force me to get my equipment out of town.

From that letter, and the return letter from the village lawyer, the Village of Cambria, Wisconsin has proposed passing a ordinance limiting, among other things, the number of pieces of farm equipment a person can display.

At the last board meeting I mentioned to them my feelings about this ordinance and the Village President (the mayor) lead me to believe by his comments I was the only one in town that cared about it. Well, to find out for myself if he was right I posted around town at a few of the businesses a cover letter with the proposed ordinance.

About a week after I posted them the mayor finally came across them and that night the Chief of Police (we only have one full time cop) was at my door saying I was misleading people and I was blowing it out of proportion. I had hauled 3 things back into town to display and he was saying I had to get 2 of them out of town or the Village was going to remove them.

This went on for 10 minutes or so untill I told him "Well, do what you have to do because on the advice of my lawyer in order to be grandfathered in I need to have what I want on my property.

As soon as I mentioned I had a law dog he mellowed out a bit and said he was going to give me a chance to get it out of town. I said he might as well write me up now because it's (the equipment) wasn't going any where. He then got in his car and left.

Am I out in left field on this one? If you could please click on the link below and let me know what you think. The top part is the cover letter and the bottom part is the proposed ordinance. I would hate to give a lawyer $$$$ when I could use it to buy more iron. :-)

You don't sound like you are out in left field. I've had a lot of trouble here in Kalamazoo, Michigan with things in my back yard, and surrounded by a stockade fence. They were enforcing a neighbor's complaints against me, and not enforcing my complaints about the neighbors. The person in the department evidently thought I would be easy to pick on because I'm disabled. I use crutches for short distances and a power wheelchair for longer distances. I can follow and bid in 2 auction rings at a time with the wheelchair. Well, now, I have a big red and white pole barn 24 x 24 feet 15 feet tall going up in my back yard. I'm building it myself, and have been working on it since February 2001. I have been getting a lot of positive feedback about it from my neighbors. The little pile of aluminum windows and doors and lawn mowers I was dismantling for recycling is hidden inside the barn, and is now 10 feet tall in the barn for dismantling this winter to sell. You are correct to fight the ordinance, and you should find out what is motivating the ordinance. Fighting unwanted laws is what our country in founded on, and is what our forefathers fought and died for.

you are lucky . where i bought my farm. they had a bunch of commisioners get into office promising no new zoning. now they are drawing up ordinances and will make them law without letting the public have any say in it. most of this is when real estate types want some new territory to turn into housing divisions with covenents so they can make more big money! just some peoples greed. bin laden didnt have a chance at destroying america! a few greedy moneyed types are beating him to it. and we are helpless to take up arms against them to fight them. we cant outspend them and our lawyers and theirs usually are buddies and crooked as well.wonder what they are going to do when our food comes from the same big oil types that are always saying they are against us. ??i dealt with the courts before. and between the hog tax vote and last presidential election being overturned i know my vote is useless!!

AC,

Cambria is located about 20 miles east of Portage and 18 miles west of Beaver Dam off of Hwy 33 on Hwy 146. A small place of around 750 people.

I would invite you by the house but I'm heading out tomorrow for 2 weeks at Ft. Hood, Texas for the Army Reserves.

HI Gene

First; is any of your neighbor's complaining?

If no !! , than why the ordinance?

Just because the they wish to pass it , they sould have a complaint in writing.

DO you have a business or hobby that uses these types of things? If you think they are ART that may make the differents, self expression, Freedom of speech. I would make sure that they are in good order and clean. Paint not coming off ( lead) no loose metal or sharp egdes , No health problem. You may need a fence . If they get a bug up for you , they can be a pain.

I live in western PA . Not many farms left and loosing more every year, I try my best too get a long with everyone, the Golden Rule. But I'll have had some fun in areas like this , the twp. suppervisers(sp) just look at me if they see me at a meeting , and say Hi . You can see they are think ing NOW WHAT !! Not too hard for me to get a couple of people on my side, or to a meeting, I can get a bees nest stirred up for them to deal with , so they just look at me funny , I'm not a trouble maker, but they don't like long meeting. Easyer to make me at easy than to get me going, around to the twp. and get a mess started.

You have to be at the meetings , If you talk about the laws (ordinance) and say at home well , you eat what you sow. Boy don't get them Mad they don't like that , and than you can have trouple. We all make misstake and if they are watching than, they nail you one way or and other.

I hate new laws (ordinance), rules they must be there but, they come about and change things. Tell someone too often that they must do and have to do things that may not be fair or right in there eyes. I like my freedom to do AS I PlEASE TOO !!. I hate being told you have to do it this way. Would be better to just ask and find some middle ground, but too often that doesn't work so they start with rules , well ..... Good Luck Punchie

Old Iron, Looks to me like its time to move about
time to move 50 ft. past the city limit sign and set up house keeping. If the city annnexs you into
the city later you will be grandfathered . I would not live where someone can decide what you can ,or cannot have on my place. I realize that towns need ordinances to maintain a certian decorum or someone will have a 1985 Buick up on blocks in their front yard, with Blood Weeds head high there too!!
There is no easy answer. Good luck.....
IMO.. We should have as many old tractors and plows as we can haul home!!

keep after them and keep the updates coming. I've been having a related problem with the city of Olean. Some yuppie vynil sided home lawmakers passed a law a few years back that allows the city to fine people for not painting their homes. My first house was made up of two apartments one up one down. we lived in the downstairs until we built a new house out of town. got a letter stating we needed to paint the aprtment house. I have a feeling the guy who's been trying to sell his 5 bedroom house on a postage stamp sized lot for 2 years turned us in. prolly thinks it won't sell cause we need to paint.(10 feet of grass on three sides of his home and none on fourth is more likley cause). anyway I object to being told I need to paint. wasn't a gated community when I bought it but, seems like one now. house needs paint I admit that, I'm gonna paint it too, if I didn't like the neighbors I'd paint it flouresecnt orange. However the front WILL BE LAST. there that's my rant.

I had a city guy, here in Kalamazoo, Michigan, come around a few years ago and complain about the paint on my house. I'm a guy in a power wheenchair for distances and crutches for short distances. I bought some scaffolding, and vinyl siding and resided my house. Now they will never have the chance to bother me about paint again. See my later post for more.

forgot to add the fireman who sold me mine also sold the other guy his. I know the owner, told him not to buy it in the first place. cause the P.O. did some terrible work on both and his was way over priced.but he had wanted to have his daughter near such fine people as us. mine was painted the year before i bought it started peeling year after. there's 120 years of paint that have to be removed before any new paint will stay on it. now I'm REALLY done ranting. fer me it's a lost cause.

keep it up don't let them win without a fight talk to everyone you can and get there feelings on the matter I think your letter is right on the money and it has your board sweating a little seems as though not many other people know whats going on as long as the stuff is displayed tastfully there is nothing wrong with it and have generally found that people (even city folks)find it neat to see these kind of things. good luck mike in ore

A couple of questions.
1. How long has this village been zoned.
2. Did you own the property before it was zoned.
3. Is the zoning ordinance worded that if you
owned/occupied/etc before a such and such date
that all uses of property is allowed. (grandfathered in). under this zoning ordinance.
If your answer is yes to 2, 3 you got them beat.

Our county tried to pass an ordinance where I live to make people haul away all their old stuff,
And we live out of town!! in the ord. if a car or truck didn't move in 3 days it could be considered abandoned and the county could come on your property and get it !! Including old tractors and farm machinery.They scheduled a meeting on a work day so people wouldn't be able to come BUT the word got out and so many people came that they had to move the meeting to a larger building, should have seen it!! some people in the crowd even started yelling that the commissoners were commie's.the meeting got out of control and only ended when the commissoners tore up the proposed ordinance and threw it in the TRASH!! then everybody had a good laugh and went home.even the commissoners were laughing. morgan

I wouldn't let up one bit. Don't think there is any law says you can't got to neighbors and other town folks trying to ralley they to your side. If there was we wouldn't have any campaine signs all over the place. If you shut them down on little things it will make it that much harder to push something else through. You need to keep working on other towns people to ralley them toward your cause. There is safty in numbers.

Get the lawyer. Best money I've ever spent is using one to write all my contracts. $35.00 gets me a "nice" letter that brings all kinds of officials in line.

I sure don't know the right answer. Since it ain't my money, I'd say "get a lawyer and fight that nonsense." Our little town did something similar with mailboxes--some folks had cute little mailboxes in various shapes (tractors, animals, what-have-you). Seems that didn't suit some folks so they passed an ordinance banning them. Would be nice if folks would stick up for their rights before they're all taken away.

But truthfully, it is that kind of nonsense that made me buy my little farm away from people and town governments. I was sick of it, and it was easier to move than to fight city hall.

Tom,

Believe it or not we had a fight here 2 years back over mail boxes. Back then everyone was required to have a P. O. Box untill someone found a post office rule saying if you lived 1/2 a mile away from the post office you could get home mail delivery. It took a city wide vote to get the mail boxes because the Village Board was afraid what kind of boxes people were going to come up with.

I would love to get a place out in the country but if I was to do that now they would think they won and I'll be danged if I'm going to let them think that.
