Found the problem. I'll know tomorrow. Got to thinking after one guy said a cylinder might be leaking. Well I cleaned of some of the hay/dirt and got to looking at the hyd hoses. Found a real oily place under one of the grauds and will pull thew guard off tomorrow and see if its the hose as I'm thinking it might be. Figure I will switch the 2 hoses form close and open and also switch them end for end so I can see and then if that fixes the problem with it staying closed I'll repale the leaking hose and also be able to ope it with out a leak.
Thanks guys some time you just need some help to make you think about thinking how things work

One thing I always do when a tailgate won't stay shut. I make sure the tailgate is closed and then unhook the hyd. hoses and tie them back on the baler. If the gate still comes open then it is in the baler, if the gate stays closed it is in the tractor.

That type of diagnosis does not work on every baler. What about balers with bad cushion or bleed back control valves? If you have a bad cushion valve the baler will act just like a tractor having a bleed by problem.

That tells you it is in the baler system and not the tractor.
