Generator trailer name, question of liability?????

I bought a Winco generator and put it on a 2 wheel trailer. Tried to make it as neat as possible(not just a pair of wheels and hitch).
I would like to take the name Winco and enlarge the lettering and make a stencil to put the name on the tool box and on the rear end. I did not make this trailer to sell, just for my own use.
The neighbor and wife say I can not do this because it it not made by Winco and that I could get sued if I put the name on the trailer. But could I put it on and then when I no longer have use for the generator take the name off and sell it???? I painted the trailer the same color as the generator, off white rims, new orange pto cover,new silver screw jack, etc etc.

I wouldn't think it was a problem. I did warranty service for several window brands. I had several of the names on my pickup/trailer. NONE of the companies comlained about it, even though they ALL saw it. It is concidered advertizing, not to imply manufacture.

Hey, I got this figured out! Add a little bit to the "C", so it looks like a "G", "WINGO", and let the suits try to figure out what that means!

I'd tell my neighbor "not to worry about it" in a loving but sarcastic way. As for the wife you better say "yes, dear" As far as the name goes, Do you ever recal seeing name brand decals on the back of somebody's pickup truck, speed equipment, racing cams, etc?

I wouldn't have thought this would generate so much interest. Why not just use the name ITCHY on the trailer, Trying to get a corperate lawyer to figure out what a WINCO ITCHY is should be interesting.

by putting their name on your trailer you could possibly make them liable for any injuries or damages caused by your trailer, no matter how slight. lawyers allways go for the deep pockets.

Why would Winco give a care? If I stick a Case-IH decal on my pickup I get in trouble? If you were selling them then maybe, but large companies don't care about an individual showing his support for the brand.

In your case, I think the neighbors might have a techincal point on using the name, but in reality there is not anything going to happen to you. The issue would be using their company name without getting permission, not liability?

As to liability, you built the trailer so you are liable, no matter what, if any, name is stenciled on the trailer.

I don't think it's a liability issue, but a copyright type of issue? And for your own use, you should not ever run into any problems. If the company would ever see it & for some reason complain, all you need do is paint it out. There would be no penalty unless you wanted to fight that.

Anyhow, my simple dirt farmer view of it, how lawyers twist laws I can't fathom.... ;)

Your wife and neighbor may be right. I know a fellow who was making bumper stickers with the John Deere logo on them. He recieved a visit one day from a John deere corporate exec., and was informed to stop immediately or legal proceedings would begin. I think the real problem was that the man was selling those bumper stickers, and John Deere was not recieving any royaltys.
