Man. I thinks I buys a 970 Black Knight [clone]on Ebay on Sunday at 5pm. Then on Monday at 5pm I get a email saying it was sold on the Friday before, private sale. The description says it can end early at any time. But isn't is a live auction till he ends it. The auction went to the final second, and I was the winning bidder. I have a contract, don't I not? Ebay #7500604821. I am going to have a couple of dark beers on this one,....later.

I'm looking for some vac eagle hitch parts. Need the lower draft links and the lift arms with the clevises that go fromthe lower draft links up to the arms that come off the rock shaft and the leveling screw. E-mail me and I'll see if I can make clear what I need.

Thanks

Don

I think you have a very legitament complaint because if it had sold locally the auction should have been stopped before it had run its' course. I guess it depends upon how hard you want to pursue it.

Realistically, I don't think you will get anywhere with it however. Ebay makes its' money off of the sellers so they tend to go light on any kind of punishment as meted out to them.

Over the last 6 years I have bought and sold on eBay under 3 different names. I could write a book on the cheap tricks that people have tried (and sometimes suceeded) to pull on me both as a buyer and a seller.

Don

I wouldn't lose any sleep over this one!!

Didn't use the right colors for a black knight etc.

Also don't think a torque limiter designed for 90 horse would stand 120 very well not to mention the PS and Ring gear.

There are other fish in the sea. But then again I don't have any love for the 70 series. Just don't think it was Case's finest hour. 90 series was a much better unit.

You can report him to the IFCC. That is the government agency that takes these complaints. The address should be available somewhere on the ebay site under,"Safe Harbor".

Hi, Don I would say thats your tractor! The seller should of stated in the ebay ad the tractor is for sale locally, can end auction early. I just looked at it and it didnt say anything like that. I won a auction on ebay for a corvette got it for $8000.00 the seller wrote me and said that was to cheep and wouldnt sell it to me! It was a no reserve auction then the guy gave me bad feedback saying I didnt have the money and waisted his time!!!! where do these people come from?!!!!

I thought when you listed something on ebay, it had to go through the auction, according to ebay policy, or you could face suspension from ebay.

I see many auctions that state "Reserve the right to end the auction early because item is available for local sale". Is this officially OK with ebay, or do they just turn a blind eye?

I would give bad Feed Back. If He will not sell to you ,You are the high bidder on the tractor ! Just why did He list it IF HE IS NOT GOING TO SELL IT ? After all he listed it with no Reserve ! HIGH BIDDER WIN's !After all just because you buy and sell, he should be glad some even Bid on it ! He must have more MONEY THAN BRAINS !not much of a seller ,just what kind of a farmer was he, A DUMMY ! I hope you can Force Him to Sell it to you ,with the help of E-bay !He's just as bad as the Scamers !

I'm no lawyer, but my understanding is that you have a legally binding contract with the seller. Depending on how bad you want it, you could probably prevent the seller from transferring possession to whoever the "local buyer" is, or demand to know where your tractor is and demand it or threaten to tie it up in court for a few months.

For my part, I am fed up with E-Bay sellers. They put something up for auction, put a reserve on it, then say it's for sale locally, but won't disclose the reserve. If it's for sale locally, what is the asking price? I bet it's pretty close to the reserve, but many won't say that either. I am convinced the "for sale locally" is a ruse to end the auction after they test the waters etc. I have lost auctions to people who come in at the last minute and outbid me by a few dollars, only to see the same item up for sale a week later, by the original seller. I think they just had a buddy bid to avoid selling it for what they deemed too little.

Of course, heaven forbid one of us bid on something, then want out when we find the item was misrepresented! The old "an auction is a legally binding contract" comment gets drawn like a weapon by sellers in those instances.

Here is some info on your situation. this was copied and pasted from e-bay.

Sometimes something goes wrong and you can't complete your listing as planned. If needed, you can choose to end your listing before the scheduled date. If there are bids on your item, you can cancel them.

Reasons for ending listings early include: Note: Your account will still be charged listing fees (such as the Insertion Fee) if you end your listing early. Consider revising your listing first if there are aspects of it you want to change or improve.

1. The item is no longer available for sale. 2. There was an error in the starting price or reserve amount. 3. There was an error in the listing. 4. The item was lost or broken. -Timing Matters When there are 12 hours or fewer remaining and the item has a winning bid, including a reserve met bid, sellers may not make any changes to the listing, including: ending the item early. Sellers may cancel bids, but not end the item adding to or changing the item description converting the item to pre-approved bidder Canceling bids or making changes to a listing with bids when there are 12 hours or fewer remaining damages the buyer experience and can undermine trust in the marketplace. To end your listing early, follow these steps:

Type your item number into the End My Listing Early form. (You can get this number on your listing, on your confirmation email, or on your My eBay page.) If there are bids on your item, choose between: a. Cancel bids and end listing early or b. Sell item to high bidder(s) and end listing early If your item has no bids, you'll skip this step. Choose the reason you're ending your listing early. Now your listing will end and will no longer be displayed on eBay. If there were bidders, they will be emailed that their bid was canceled and the listing ended early. Note: Sellers are not permitted to cancel bids and end listings early in order to avoid selling an item that did not meet the desired sale price. This is considered to be reserve fee circumvention. Although there are legitimate reasons for ending a listing early, abuse of this option will be investigated.

About all you can do is report the guy to ebay and get him a warning. They have a new deal now that wont let them cancel the auction unless its more than 12 hours before end of auction. That sure sux you wont the auction and didnt get the tractor ,I saw it on there.
