I BOUGHT A TRACTOR FROM A BRAD WATERS - 251 COULTER RD, MARYVILLE, TN 37804. THE TRACTOR IS A SUPER 66 OLIVER & WAS LISTED ON 4/08/2007 ON YTC. I PAID BRAD $3,300 FOR THE TRACTOR IN THE FORM A CERTIFIED CHECK. WHEN WE WENT TO PICK UP THE TRACTOR BRAD HAD SOLD IT TO SOMEONE ELSE AND WOULD NOT MEET WITH US, HE HAD HIS YOUNG SON GIVE US A PEROSNAL CHECK, IN WHICH HE PUT A "STOP PAYMENT" ORDER PUT ON IT. CANNOT REACH BRAD AND WILL NOT RETURN CALLS. THIS MAN IS A THIEF & BUYERS BEWARE OF HIS SCAM TACTICS!!!! IT IS A SHAME THERE ARE PEOPLE LIKE THAT OUT THERE! "BEWARE"

It appears I have been the victim of fraud from this man as well. I made a deal with him to buy a 77 radiator top for $100 plus shipping. He insisted pay by money order. Dave Shorey from Asheville, NC was the name that placed the ad. However, his email name on initial email communication was Dave Wilson. He told me he was selling this for his in-laws who do not have email/internet and I should send a money order to Henrietta Waters, 251 Coulter Rd, Maryville, TN 37804. I did just that. Never received the part, never returned emails, never returned phone messages left at the phone number (865) 982-6003 listed for Henrietta Waters. I cannot find phone number for a David Shorey or Dave Wilson. I believe he is a crook.

If he won't at least return your money then he needs to be taken before Judge Judy. Get proof the cert ck was cashed, that his ck was stopped, and a copy of the sale to you. Should ask for milage to go get it only to return empty handed. How far was it? Same state?

You have one (of many)small problems. If this went on for 6 months etc. And you did not pick up the tractor you have abandoned it or could be charged storage. State law will vary on this one but look into it otherwise proceed on fraud. #2 Someone stole the tractor (he is not responsible for it).

UNDERSTAND ALL OF THAT. WHEN WE FIRST PURCHASED THE TRACTOR HE INDICATED THAT WE COULD TAKE AS LONG AS NEEDED AND NO CHARGE AND EVEN WANTED SOMETHING DELEIVERED TO MARYLAND. HE HAD ANOTHER SUPER 66 TRACTOR LISTED ON YTC AND WE THINK THE OTHER GUY MADE AN OFFER ON OURS TOO!!! AND HE TOOK IT!!! TRIED CALLING HIS PHONE NUMEROUS TIMES TO SET A DATE TO PICK WITH NO RETURN BACK!! WELL BEFROE THE TIME WE WENT DOWN FOR PICK UP. ALL THINGS SAID, HE WROTE A CHECK TO US AND PUT A STOP PAYMENT AFTER WE DEPOSITED IT!!! THATS THE SHOW STOPPER.

Pick up your telephone, call your local sheriffs department, file a report, ask the county states attorney to file theft charges against this man. In Illinois, you write a bad check, you can be prosecuted and the man could have to pay 3 times the face value of the check, plus court cost, etc,etc,etc. But the first thing that has to happen is a sheriffs report for theft. Just make sure you have the check that he stopped payment on, the certified money order copy you have when you bought it, and any and all correspondence concerning buying the tractor, any and all receipts you might have to prove you made a trip to his town to pick it up.

I PLAN ON DOING WHATEVER IT TAKES TO BRING THIS MAN TO JUSTICE TO MAKE AN EXAMPLE. I JUST WANTED EVERYONE TO KNOW ABOUT THIS GUY IT HE TRIES TO DO THIS AGAIN. IT IS STILL UNBELIEVABLE! BUT I STILL 99% OF THE GUYS OUT THERE ARE GOOD GUYS.!!!

David, yep, most on here are real good, honest people to deal with, but there are always a few Jacka$$s that have to try to make a fast buck. Do not know what they think, that they can rip someone off for 3000.00 and no one is going to do anything.

Was written a check a while back on a closed acct and the writer knew it too.Makes one wonder what they are thinking???Are the odds with them on getting away,do they think that they are???I have to sleep at night,I guess it doesen't bother some.

Contact your local prosecutors office, they will be happy to file charges. You are no different than a retail store when it comes to bad checks. Typically it does not cost you a dime to turn it over to their collection proceedings.

BUT:!!! You should not have given him the full sale amount in the check you gave him! Thats a great way to be taken to the cleaners! What you should have done is given a check for 10%, Balance upon delivery, either at your home, or at his when you go to get it! And, if you do go to pick it up--be sure you have the money in cash, and only hand over the cash after the machine is on your truck or trailer! Also, its best to take several friends along--sort of insurance against any claims about how you strong-armed him and stole the tractor! Nothing has to be said by the accompanying friends, except "hello" and "Good-bye"! Just have big friendly smiles, but not much small talk. Unfortunately, it seems you have been taken! You might get some help from the local law, but he has a few things in his favor. (He's been cheated by some big city guy--how can he get out of this") Or he's just one of the local "Good ol' boys" who never do any wrong! Just try and prove anything!

YAH I KNOW WE SHOULD HAVE DONE THAT, BUT I GUESS WE TRUST PEOPLE TOO MUCH. WE HAVE BOUGHT OVER 40 TRACTORS ON LINE BETWEEN EBAY AND YTC AND WE ALWAYS HAD GOOD LUCK WITH THE PEOPLE AND IT PROVES THAT MOST PEOPLE ARE HONEST AND GREAT TO DEAL WITH. HAVE LEARNED MAY LESSONS!!!
