I recently had a tractor for sale on this site. Had about 100 emails, and about 20 phone calls. Had one man who called from out west, said he didn't have a computer(not sure how he found the ad). Asked me if I'd send him some pictures of the tractor in the mail. I told him I would, but it'd be about a week before I could take some decent ones cause by the time I get home at night it's too dark to get any pictures taken. So a couple days later, a nice fellow from New York state calls me, we have a nice conversation, and he comitted to buy the tractor, sight unseen, we agreed on a price and he is gonna come get it in a week or two. I didn't have the other mans phone number, as I was not going to keep track all the people who called or emailed to ask me questions, as most of them are not serious buyers anyhow. Couple days goes buy and the guy who wanted pictures mailed calls me and I told him after we talked, another man comitted to buy it, and I was always taught it is the first guy with the money who gets it, unless the seller commits to hold it, which I did not. The guy was really mad, got half smart about it, then hung up! Maybe I am crazy, but I thought that was out of line?

deposits in reply to Luke S, 11-30-2006 10:54:47
I don't like deposits or down payments. Everyone seems to think they can get them back. I try never to take a deposit, if I do I make a written doc that says you owe the rest by such & such date or you forfiet the deposit and the purchase. Then I have them sign it. It still makes for bad feels when they don't hold up their end, but I can't help that. Best just to say I only except full payment, first with cash buys it.

You did the right thing. The guy only wanted pictures. You wanted to sell it. If the guy got that mad, he would probably would have wanted to jew you down even lower on the price. If he said he was coming to get it, then it would be a different story. He'll find another tractor. Dave

I can understand the fellow's frustration - sounds like he woulda been serious at looking at it unlike the idly currious.

You did the right thing. You made no promises, & sold to the 1st with cash.

His comments were just frustration - kind of the opposite of backing out of the deal, he wished he woulda barged in a little stronger is all.

Is how it is, don't see anything wrong with either party.

I think you did the right thing, apparently there are a group of folks that make a hobby out of getting pictures of equipment and tractors for sale off the internet so someone just asking for
a picture means next to nothing.

Boy can this get funky! I love to go to car shows and flea markets. If you are walkin down an isle and see sometihing that pushes your button, PICK IT UP! Now you have nine tenths of ownership by holding it. If you like it then buy it now and the person can always put it aside for you. I have missed out on several very good items by just walking a few feet and then turning around to go back. ALL GONE and TOO LATE! I would say the first with the cash is the winner. There are tooooo many BOZOS out there. Jeffcat

Okay,

So, if the guy from New York fails to show, just remember what you did to one of those "non-serious" buyers and don't get mad.

Street runs both ways.

You did the right thing. You didn't promise to hold it for the "picture guy" and he didn't promise to buy. Long distance sales can be difficult. If you want to buy something over the phone thats far away you must promise payment, but seller has to have some trust that payment will come. I bouhgt parts 8 hours away, but seller agreed to hold and I sent payment immediately. I tried to buy something over the phone once. It was exactly what I wanted by part number. Seller was on the road on his cell phone. I said I would wireor mail payment asap. He said "he doesn't play those games" and I would have to wait til he got home on Saturday and be the first to call then. Now, how can that work? Talk about a game.

I'm on the other end of a simular deal.

Guy had a tractor ad on here in late Sept.

Told him I would come take a look and if was all he said I would buy it.

The catch was I didn't have time then with harvest in full swing to drive 4 hrs. one way to look at it and bring the money.

I told him if someone else gets there with the money and he sells it I would not be upset.

Well I emailed him last week and he has not answered yet. I wish I knew if he sold it yet or not. I lost his phone # and the ad is gone.

Is there a way to get into the PhotoAds from late September.

Gary

i agree the guy was out of line gettin mad. if i see something i am interestd in buying, i call the seller, make an appoint ment, give him my name and phone number, and show up on time, with the trailer, cash in hand. if i like what i see, i write up a bill of sale, pay in cash and take it home. no nonsense that way, and everybody walks away friends.

Any serious buyer should offer a cash deposit for safekeeping the goods until he can pick them up in a reasonable and pre-agreed on amount of time.If not see Glens comment below,Money talks BS walks.

That's just what I did when I wanted a piece of equipment about 750 miles from me. I sent a deposit, picked it up a few weeks later and everything was as it should be.

It happens to all of us.. I had some old lathes & parts for sale.. A guy wanted them, promised to be back in 1 week with cash. He kept asking me to promise I would not sell them to anyone else. A few days later, another guy showed up with cash, wanting them. Like a fool, I told him I had them sold... The original "Buyer" never came back, so I called the cash buyer back, but he was mad & would not buy them... Heck, I just decided to keep the stuff...

He was out of line getting mad if he hadn't seen it yet or paid anything down or agreed to anything with you. You should have reminded him and others that call that you never know as the other guy that says he is committed to buying it may show up and turn it down and then you might be the one getting mad? But don't do that just remind him if he turns it down and then changes his mind it may be gone to other callers in a few days too. Money talks n BS walks lol.

well, I don't feel so foolish anymore, have a wood chipper for sale, buyer #A called several times with questions and finally made appointment to come see it

as I'm going out the door, buyer #B calls and offers full price cash and will tow the machine today, I told him I had made a promise to A but would call him afterwards one way or the other

long story short, A wants it, puts $100 in my hand rest of cash shortly, I tell B the bad news, A then backs out and also wants his deposit back, B has bot another chipper already, finally gave A his deposit back to stop his whining

from now on first cash in hand has it, bring the cash with you if you come to look at my stuff

You did the right thing. I don't hold something unless there is cash money down on it. Recent car sale: "we'll take it." And my reply was, "That'll be $500 cash down right now, or it will be sold to the next person with cash." They pulled out the checkbook and wrote it up, called the bank to be sure it was good and shook hands. Been waiting for the rest for 2 weeks now, but that don't bother me when I've got cash in hand. :o)

How I handle it and would expect other to handle it. If some one commits I give em a week to get me paid, tell all others they can come look if they want , but a sale is pending. If some one happens to want it and has the cash I tell them honestly it's sold, if the deal falls through, I'll call them ASAP. I have been one that has been promised over the phone it'll be held for me a day or two only to get there and it was sold. Ya cant put promises in the bank, but if you expect some one that says they'll buy, to buy it. Ya darn well better have the dignity to hold it as sold if ya told the guy its his.

Well thats the thing, I didn't tell the guy anything. I told him I'd send him some pictures as soon as I could. The other guy, who after talking to him, I know he's the real deal, says I'll take it, be out with green cash money. Then this other guy calls me back and says I shoulda calle dhim and told him I sold it. Well heck, I had about 20 phone numbers in my cell of people who called about it, but I didn't know which number was to which guy. Maybe I didn't handle it right, but I can't believe how upset people get.

you told the guy out west you would hold it for him till you got the pics. Otherwise, dont let it bother you. This is an all too familiar situation that you'll hear about more and more as time wears on.

I allways sound like a politician when I sell something. I avoid committment at all cost till I see cash. In your situation, I'd have told the out west guy that first come with the cash is first served with the goods.

I at least expect someone to hold it long enough for me to hang up the phone and then drive to look at it. Nothing I hate more than driving even only 30 min. to an hour and someone 5 minutes away who called later than me but can get there faster ends up with it. I always seem to find stuff in another town up to an hour away from me.One thing in peticular was my daughters 4 wheeler I told the lady on the phone I would buy it if it was as good as she said,And I had the cash in hand just give me 45 min. time to drive there. I finally convinced her to do this so I was able to end up buying it.
