If someone is hauling a over wide load with an alledged permit(gas well drilling rig) on a country road, can they legally force me off the road or do they have to slow down and let me pass? The county road was wide enough for me to pass but the WOMAN in front told me if I didn't get off road she would call police!!!!! Who has right of way? Tx Jim

davediehl, these trucks were not escorted by a Police officer but by a pick-up with flashing lights. I normally have no problem yielding to wide loads but this woman shacking her finger at me threatening me with turning me into law enforcement because I didn't pull over quick enough for her got me riled a little. Thanks,Jim

I would have shook my "your number one" finger back and used the cell to call a police agency. Might have even parked in the middle of my lane til they got there. Then the identification would have been brought out. But thats me.

Even with and over size load they have to be on there side of the road. If there over the ncenter line and hit something its there fault. BTDT and I have hauled 100s of over size loads and was always told I had to keep it on my side of the road or if something happened it was my fault. Now in places they can stop you but only till they get past a narrow area. But to tell you if you don't get out of the way or else there the ones that would be in trouble BIG TIME. As I said BTDT. And no one call do as you said they did. I would have told them call the cops PLEASE

In our state, a "superload" would have a state police escort. At that point the lights on the police car would be on giving you the right away and ability to cross the center lane forcing others to pull off the pavement.
If you have a wide load permit and you crash into another motor vehicle, the crash report will reflect that you were left of center as well as the cause of the crash. Oncoming driver is not in violation. Reqardless of escort or not, being left of the center lane on any 2 way road is a driver responsibility to ensure the safety of oncoming traffic. Imagine if you were on a blind hill, how many are even going to see you in time to stop/move/crash. County roads expecially, what happens if you meet a big farm impliment or tractor with duals near a ditch. Permits don't make one exempt from common sense it only allows one to be over set weight or size maximums.

Dave i will say round here most people will really pull over for a house trailer or boat etc. But a tractor or slow moving object and its like Daytona 500 trying to pass???

I will not disagree with you at all on the fact that most will be curtious to big trucks with big loads. In fact its the same around here when it comes to tractors. 2 years ago we had a car pass a tractor and crossed the center line to "play chicken" on a county road with a big Case running duals. The passenger claimed the driver told him to "watch this" as they traveled on the yellow center line. The bad thing was that the duals on the center line of the road impacted with the drivers side of the car and killed the driver. And of course you can't file charges for being stupid on a dead guy. The family of the deceased sued the farmer for operating after night. The tractor was properly illuminated with lights and flashers. There was nothing that ever came from the suit. The farmer was not negligent and it was ruled as accidental. No one will ever say any driver is smart, he's just lucky that he hasn't tangled with an idiot driver with bad timing. Things can happen to anyone.

Well i always firgured it this way She may have the wright of way but I AM THE ONE WITH THE BIG TRUCK. Now if you would have had a Front ESCORT then the ESCORT should have had control of the road . While hauling and oversize under permit you get over as far as one can BUT MYSELF i will never leave the pavement .

You say "alledged permit", if you had no permit for an oversided load than she had the right of way.

Now if you meant to say a "legal permit" the right of way is equal for both parties. Both should slow and try to get past each other.

Gary
