Buyer and Seller Feedback - Watch out for 'Bo' Koch from Willis, Texas

This guy Koch wanted to buy 2 parts from a friend of mine for a John Deere GP, only when he sends the check, he adds an extra part onto the deal hoping it would slide through. When called on it, Koch admits he made a mistake with the check. My friend cashes the check (he should have sent it back for a new check - he doesn't because they are supposed to be good friends!). Anyway, then the deal goes bad because of this extra part, a carburetor worth $500, so my friend sends him back his money. This Koch guy refused to cash the check and then takes my friend to small claims court saying the check he got was no good. Bank records and a state police investigation (all available on record) show there was no bad check. The money was in the account as it should have been. No charges were filed and my friend was never arrested or charged. Matter of fact, the case was closed and was closed because there was no criminal aspect according to the official copy received. So when this Koch guy files the small claims suit, he does not spell my friend's name correctly so my friend does not get the paperwork for court - who knows where it is sent. After the court date, somehow the name spelling is changed and my friend receives notice that he lost the case and has to pay more than the check was for because Koch cried and asked for interest on the money. (Somewhere here the judge missed that it was Koch who did not cash a perfectly good check and Koch had the mindset that he 'wanted to make my friend's life a living hell' as he said to him on several occasions.) My friend thought he did the right thing here and sent back the money so each party would be "whole". The only "hole" my friend forgot about was this Koch guy. So just watch yourself with this guy, he is bad news and will screw with people who might think he is their friend. Just thought y'all should know.

I have heard of this situation and have to side with the seller. While I know of both people, when deals like this turns, all you can do is get out of it as best you can, which the seller here did or tried to do. If the buyer does not cash a perfectly good check, shame on him. He was given an opportunity to get his money back and chose not to do so. He should not be entitled to interest and should only receive what he sent. To not only refuse to cash the check and then pursue this in a court type setting and then manage to get interest tacked on top is absolutely shameful. And I don't care who it is that is involved. If a deal goes bad, get your money back and find your parts somewhere else. Simple as that. To say that you are going to make someone's life a living hell and then follow through with that is pathetic. I side with the seller on this one.
