It's called an Executive Order. And a different Executive Order is why the prisoners were sent to Guantanamo in the first place.
No doubt most of the guys there should be there. And no doubt there's a few who are only there because they were in the wrong place at the wrong time, or because someone didn't like them and turned them in for a bounty. Regardless, it's been a public relations black eye for the US in the eyes of the rest of the world.
Closing Gitmo doesn't mean everybody goes home. Most will probably end up in military prisons inside the US proper.
